Default Car purchased from garage what are my rights?

We purchased a second hand P registered Car 10 days ago from a local garage, it was given a full MOT the same week from them.

Yesterday the head gasket went, something to do with hole in the radiator initially

Now its been towed to the garage and he has offered to fix it for parts at trade price and no labour costs.

But even that will be £250 if not more on a £695 car

There was no warranty but I would like to know what my rights are, I read second hand goods should not be expected to perform like new but can we push for a full repair FOC or should we take his offer?

Hello Summer

You still have the Sale of Goods Act 1979 to use if they will not pay for the repair. You should inform them that you reject the vehicle under s.14 (2) and s.14 (3) of the Sale of Goods Act 1979, due to the fault with the vehicle’s engine, and that they have failed to discharge their implied duty under s. 14 (2) of the Sale of Goods Act, that the vehicle be of satisfactory quality and further under s. 14 (3) that the vehicle be reasonably fit for purpose.

If they still haven't sorted out the problem within 7 days, you can then threaten legal proceedings to recover the purchase price together with interest.
