Hi folks can you please give me some advice on the following, i bought a vw passat 06 plate, on wed 7th may and asked the dealer if there were any hp outstanding on the car, been involved in any accidents, etc he told me that everything was fine with the car full service history no problems at all.so took the car home after looking in the glove compartment i came accross the previous owners address so gave the guy a call told him i had just bought his old car and asked if there were any problems with it, his first words were take it back and get your money back Not what i want to hear it turns out that the car has had at least 10 recalls on various faults, all of which were repaired under man/warranty and they then offered him a replacement car for the one with the faults, the one that i have just bought. What i want to know is should they have made me aware of the recalls the car has had? and gave me a print out of them, and where do i go from here as far as consumer rights go??

If the dealer knew of its history, he should of told you. However it was probably sold through the trade on a heavy discount from the original dealer who may not of told them about the problems. VW would have the history on their computer. Did you buy it from a VW dealer? they would of checked history before selling. Has it got any faults now, maybe they fixed them all before selling on? Take the car back to where you bought it and tell them what you found out and see what they say and what they are going to do. was it cheaper than book price? that be a clue if they knew or not. If there is nothing wrong with the car then I dont think there is much you can do?

Thanks for your reply Raydetinu, The dealer i got the car from is the same one the other guy bought the car from new and they are a volkswagon dealership so they should have all the history of the car, the car was not on special offer or anything infact i had to hassle with them on getting a better trade in price on my own car and got him to drop the price they wanted for the passat, at the moment it does not appear to have any faults but that may be just a matter of time. So have they broken any consumer laws or not? if ihad known of the recalls at the time i would not have bought the car, it may be that the car is ok now but who knows, can i ask for an extended warranty? are they obliged to do anything.

Go back and tell them what you know, and that they had the history and should of told you? See what they say, ask for an increased warranty/ Were the problems specific to this car or all passats? what were they, discuss these with the dealer. I am sure if they are a main dealer, they would want you to be happy with your purchase. You caould also cantact VW direct and see what they say, have they a policy regarding selling on replacement cars. Maybe it had a thorough check before being resold? these are things you need to know. You need peace of mind and for that they have to give you some answers and reasssurnce. I dont think however they have done anything wrong unless they missrepresented it, by saying it never had any problems, when clearly it did.
What about service history, did it come with any?

They don't have to volunteer anything in the way of information, but anything they do tell you has to be true. If you had asked though that would have been a different matter and he would have had to tell you, so no consumer laws were broken.

well took your advice went back to the garage on sat, told them i had spoke to previous owner and what he had said, the manager more or less said the guy was lying and that he was very bitter towards them?? and that he did not do a straight swap for the one with the recalls it was a trade in for a newer model, and also that the recalls were not only the car i had bought but a few others as well same model. I then asked for a print out of all the faults and recalls the car had been in for, they were not keen at first but then went to the service manager and got it for me they said all the work done was done under the warranty and that the car still has a full years manufactory warranty left and that the car was now ok.Monday morning dropped my wife off at work went to drive off and heard a warning tone there was a light on and when i had a look at the manual it said fault in the brake system the same fault the guy had told me about, so i have now booked the car into another vw dealer and phoned the garage id bought the car from to tell them what i was doing and would report back the findings from the other garage, keep you posted

Bear in mind that since you have not given the first garage the opportunity to repair, then any costs at the second dealership will be down to you.

update! as the car is still under warranty there were no costs involved, the vw dealer i took the car to checked the car using a diagnostic computer, as there are no warning lights on the dash now they said that the problem was sporadic as they could not pinpoint the fault, so the whole thing was of no use to me in the end so its back to make your mind up time do i keep the car and hope that its going to be alright and that all the faults have been eliminated or do i take it back and ask for my money back as i have 14 days from date of purchase to do so, but i dont think it will be as easy as that. By the way the warning light has not been on since mon

If you are not happy with the car take it back! no you know of potential problems it will always be there in the back of your mind. I know all cars go wrong from time to time. but this will feel like a ticking bomb, you will just be waiting for it all the time you are driving it. it this case it is probably of better the devil you dont know!

cheers CONNIF got a print out of all the work done on the car from them seems there was a recall on 22/05/07 code 10/92b6 not sure what that code means and also park brake ecu/tur 11/09/07, and again park brake ecu/poo 08/11/07 which is not as bad as the other guy was saying ie.10 recalls. the ones above refer to 1.9 tdi se, and are not listed on the VOSA web site

Ask for a full history print out from their records - This will show all claims made, both to VW warranty and also any items they paid for internally.

Dont let them tell you its data protestion etc. ou now own the car and have the previous owners details so they would not be giving you anything that breaches it.

They are intitled to 'black' out all figures on the paperwork so you cant see the costs to warranty etc.

Once you have this you will have a better understanding of the cars history.

Not sure if you have taken the car back yet or not but, if you have a warning light on the dash it will be stored in the computer, so even a random fault can be downloaded and identified by a dealer. Don't let them fob you off.

I know because I have had an intermittent fault with my 04 golf and they gave me a print out of date and time of all the faults stroed in the computer
