Unhappy car warranty/service problem

hi hope someone can help me.

I bought and bmw325ci on a 53 plate in June with an extended 3 year warranty.

Had it serviced at a bmw dealership in october.

2 days ago the stabaliser bar (connects wheel to the main frame of car) at the back drivers side snapped. This would have caused a really nasty accident if i was driving at speed as the wheel would have come off. Had the car towed to bmw where upon inspection they say that it was an old fracture and rusted, therefore the warranty wont pay out. Surely if it was an old fracture the bmw service should have picked this up.

I now face a bill of about £1400 as they say the brakes, handbrake, wheel, bearings etc etc are snapped.

If this is a old fracture surely bmw are liable as they didnt pick it up on the service and therefore the warranty wont pay out, or is the dealership where i bought the car at fault.

Can anyone help or offer any advice?

Sorry I can't help with this but hopefully someone else will jump in now i have replied. (I must admit i tend to agree with you that this should have been spotted earlier and therefore it should be down to them to fix it)

Only if the service schedule requires it to be inspected.

The way I see it: If the Main Agent claim that it is an "old fracture" and hasn't occured since you took out the warranty then it must follow that the fracture was there when you purchased the car, making the dealer liable for selling an unroadworthy car.

Snap, I would say the dealer should be liable for the repair.

I dont know if this would be the right thing to do but go back to the place who told you it was an old problem. Ask them to put in writting whats wrong and why they wont cover it. Then go back to where you bought it and tell them they have sold you an unroadworthy car. I had to do this with a telly.
