up date ...sent letter a few weeks ago asking for statements ie what had been deducted from pay.........ignored...... ....sent letter to building company thursday giving 7 days or court action to obtain theses.............Husban d received phone call from building company yesterday more or less saying up yours!!!! so now i need to know what to put on the court form to obtain the statements??? any help ......please.

MMM-first i would complain to CITB about this company and how they are treating their sub contractors with the levy.What exactly did they say on phone.I will try to establish whether they are registered on CITB early in the week.As for going to court -well this is beyond me but someone will advise if you want to go this way.If he took payments properly would prob be 15pound in the thousand.But as you say wasnt shown in pay slips so you havent got any idea how much has been taken.And not agreed to anyway.Really friendly attitude this firm has by the sound of it-maybe soon they will get taste of their own medicine.All checks so far say they are not registered in those names so now will check by phone as i say early in week if you want me to.As could be recently registered or some other mistake.Dont let it get you down. Need a bit of urgent help please .........the contractor is refusing to hand over the c1523 documents showing how much was deducted .........so the next step is court .but....what do i put on the ni form???

Maybe good time to go to Citizens Advice and ask their advice and maybe they will help you sort this out and fill the form in.Terrible that the firm will not give you this information you want.If they help you ,if you decide to go that way please post with any news.Cant believe it has gone this far.Perhaps someone will advise you on how to go about things soon.Tawnyowl keeping close eye on your thread and hoping things work out.Dont give up.Just cant understand why he will not give you this info-hasnt got anything to hide has he-nothing to lose giving you the details.Something sure isnt right.

Right i have spoken to the citb levy people and they have confirmed that the company are registered, and have also advised me to take this up with the employment tribunal..........so form filled in and sent

Its been ages since i posted on this thread ..but heres the update......we were due to attend an Industrial Tribunal next month.........but the judge ordered the company to release the paperwork we asked for and the outcome was .........we received all the payment slips a few weeks ago...........now i have all the figures i have sent the please repay me ....and you have 14 days before i take legal action still no reply so im now at the stage that i need to fill out the N1 form..............now the trouble is i know what to put if it was a bank .but what do i put for a company that i am trying to reclaim the citb levy from? any help would be much
appreciated. x

Will keep a sye on your thread and help as much as i can,Did you register the letter giving them 14 days,Perhaps one more registered letter giving them 7 days as a last chance to avoid court action which surely they dont want.Ioam still wondering if they actually paid the levy they took from your husbaands pay and all the other workers.Got a feeling they should settle with you now rather than go to court.Iam no expert on n1 forms but will look round tonight and ask someones advice if noone comes and helps before.Good luck Tawnyowl

I think the same as you ..........i even asked to see the signature but surprise surprise they had a break in and of all the things they could have taken that little bit of paper went missing lol. there 14 days are up next week so i suppose there is still time, thank you for your helpX

Hi maisielou,

Iam no expert on this type of thing but i might be able to help with the N1.

I would at first put down on a piece of paer what ur greience is and what ehy owe u, dont worry this is just notes to help u.

This is ismilar to what i would put:-

Since 01 january 2009 xyz company have been taking xx amount out of my wages as a payment towards CITB levy on a monthly bases.
I have no contractral provisions with xyz company to take this amount out of my wages.
xyz company have been asked to repay this amount several times verbally and via letter.
XYZ company and i have been involved in previous procedings at <name of court > case number If this was a industrial tribunal put that info instead.
As result of this money being taken since 01 jan 2009 in total xyz company have taken the total amount of XXXXX
i would like the courts to order than xyz company have to pay me back the total amount plus 8% per year or 0.022% per day of the total amount resulting in a total payment of XXXX. this is under section 64 of the county courts act of 1984

let me check the act cause something now tells me it is a different section maybe section 35 but of the same act. Any way note like that can help u as u will easily find what to put into the N1. then add on your court costs and claim away.

BTW u can claim all ur court cost back so the amount they have to pay u can go up.

oh it looks like i have been wrong its nothing to do with either of those
i ment section 69. its interest under section 69 of the county courts act 1984.

yes you can but letters cant be sent threw mcol.

also please be ware there is a maximum letter/ word count with Mcol so u might find it is over, dont know how much but i know it. Anyway should u need a N1 u can go to www.hmcourts-service.gov.uk or follow this to a list of forms u can fill out and print off.

Remember you need to print of 3 keep one for ur self and 2 for the courts. The trick i use is print off one and photocopy the other 2 then i keep the printed off one.

i have asked my OH to look in on this thread as he use to work in the trade
he has advised the following:

if he says that your husband agreed to the deduction ask for a copy of the forum bearing his signature. This is a important document which he would need to prove to anybody, his account any finiancial person or even the judge, to prove his case.

Also if you can call witnesses from the company that also have not agreed to the levy but they are havinng it taken off. he says if you can as if the employer finds out other employees are witness on your side he may threaten them or even fire them and you obviously dont want that. Maybe a ex employee is the answer to a witness especially one that was having the same problem.
