Default Suspension following a grievance advice please

Nearly 3 years ago I began having problems with a new member of staff for who I was supervisor to. To cut a very long story shorter I was removed from the department with the excuse of it being better for my health and an investigation took place and after 8 months my complaint of bullying and harassment was upheld. As I had been placed in a similar department on secondment I agreed to stay in the post until the secondment ended and then intended to return to my orignal job that I had had for 10 years. The secondment ended 14 months ago and I was told I had to take a different job in a completely different field and when I refused I was threatened with dismissal. When asked for this in writing I was told via email that they hadnt dismissed me but they were thinking of doing so. Since then I have been suspended on full pay. I have now taken out a second grievance about this situation and have been interviewed reagrding this. There is to be a hearing in September.
I am a member of a union but really havent found them to be very forthcoming with advice. They attend meetings with me but never actually give me any real advice as to what my legal rights are. Hence coming on here.

Can anyone advice:

Can I be made to take an alternative post in a different area of the city?
How long can someone be left suspended on full pay before the employer had to provide work?

Hi Corny

Sorry you did not get a reply.

1) Possibly - it would depend if this is a demotion - if not and you have a mobility clause in your contract then your employer may be entitled to do this, it would depend on the distance involved, if the mobility clause had been invoked previously etc

2) As far as I'm aware no actual limit exists although ACAS advise investigations should be as expedient as possible. In reality your employer will not want to leave it too long as they are paying you full wage for no work!

The only post they have offered me is same grade but not the same type of work and the area it is in would involve a lot more travel. I cannot believe that you can be discriminated against in this way for bring to the notice of management a serious bullying problem. They agree that there is a serious problem but it appears would rather cover it up and keep the bully whilst the other staff are leaving the department hand over fist
