Ex-employer payment - 1 year on..

Exactly a year ago my previous employer ( a large company ) made me redundant after 7 years. The way they went about the redundancy was very poor and the whole experience very upsetting.

One year on they have mistakenly made a payment into my account of just over 2k.. They have telephoned me ( 3 weeks after the payment ) and asked for the money back.

Since redundancy I have found it extremely difiicult to find work within the specialist field I work within and have only recently ( 3 weeks ago ) commenced a new job, so money has been tight and this 2k payment has been swallowed up by my overdraft.

My questions are

1. Do I have to pay this money back to an employer that treated me very poorly throughout my employment and then was extremely poor in the redundancy process.

2. If I do have to pay it back how can I make it most difficult for them.

3. Do I have grounds to ask them why they still have my bank details one year after my employment ceased.

Ex employee records should be stored safely where they can be accessed for any enquiries by HMRC or DWP etc. These records no doubt will contain peoples bank details. The reason you have got this money is probably more to do with the company housekeeping procedure which has not been cleansed to remove your details from the automatic payment system that they use.

So yes, make it difficult for them to get it back, but you probably will have to repay it.
