Help need spot on info please.If you allowed someone to read a medical document and told them not to show anyone else or divulge any information from it and they made a copy and passed it to other people would this be illegal.Part two this is where i need the spot on advise if the copy was coloured in on sections to hi-lite medical conditions and someone had also written something about these conditions or person would that be a crimminal act to write on that document.

Hi yes it was copied by a supervisor passed to a superintendant then to an employment relations officer then to a w.h.a nurse then to the works gp and i had no idea this copy was floating around its along story dont want to delve into to it at great length just want real legal facts from members in the know i will be taking them to court.Its took me a very long time to inspect this inspect this copy its been written on on every page ive been told this could be a crimminal act is this so.I know i did wrong i allowing him to read this document but he was intimidating me with my restrictions and yes im in a union but got very poor support so if it is a crimminal offence to write on this document would any legal eagles out there let me know.

I think we need a lot more info.
Was the document yours and was it about you.
What type of document was it.
Why did you need to show it to your supervisor.
Why did you allow them to make a copy.
How do you know who has seen this copy.
How do you know what has been written on it and by whom.
How have you got hold of the copied document.
What has been written on it.
Why were you wrong for allowing supervisor to read it.

Yes it was mine and about me.It was a medical document.I showed it to him because i was being threatened with a written warning for being of work and i really panicked has my time keeping was not the best.I told him not to show or divulge any information from this document and i did not know he had made a copy and passed it around i had no idea it existed.When i went to see the works dr he said how useful my medical document was to him.It took me 6 months to find out who he had passed this document to and how it was passed around.Only this week have i managed to compare this copy with my original and every page has been coloured in different coloured hi-lites on evey paragraph and someone has written things about me or my medical conditions on 3 pages when i asked the works gp if he did that he said the nurse did it.I just want to know if writing on this document about me or my medical conditions is classed has altering it and have these people commited a crime.

The person who copied it should not have done so without your consent. Nor should they have shown anyone, however it seems that they have passed it to their line manager who has passed it to Occy Health. The fact they have made notes on it is not the issue. Yours works dr could have asked your consent to get this info from your GP, and he has acknowledged that it has been very useful. As long as they are not using it as a stick to beat you with I would let it go, perhaps your supervisor thought he was acting in your best interests?
You could put in a grievance for breach of confidentiality by your supervisor, but you need to be sure that you want to rock the boat.

I agree with what Poppy has said.

It all depends on how far you want to push this. There is a breach of confidentiallity, but from a union point they could argue that your manager has acted in a way that any trust has broken down and from that delving into Working Contracts whether written or not, part of a working contract is that trust must exist from you and from your employers so potentially you could have breach of contract. There could be many other ways to pursue this but you need to seek proper professional legal advice which you are entitled to through your Union. If your union reps aren't doing it go above them to the point of a national officer if neccessary. Don't let the rest, they should be giving you more assistance.

Anything I have said is personal advice and not legal advice you should speak to a legal professional.

Left the company after 10 years service no pay off and told i will not be getting anything out of the pension till i retire thats what you get for making a complaint when your in the right against a large car manufacturer in castlebromwich.Also finding this very hard to get in court nobody seems to want to know allthough the supervisor copied this document without my consent it seems they can do anything they want once you allow someone to read it.T@G unite waste of time what a corrupt union they have on this site and i took this to a higher level in birmingham same response.If any solicitors out there drop me a line i want to get these people for what they did to me and the hr dept for the after treatment they gave me.This large motor company thats just been sold by f in america is a disgrace and no employee should be treated this way its disgusting.This supervisor was not concerned about me he abused my medical restrictions and my private medical life he should have been sacked.
