Default Upcoming Tribunal

Hi everyone, looking for a bit of help with something, bit short notice but anyone with experience that can offer anything.

Someone I know has their Tribunal hearing coming up soon and the other side have delayed delivering their statements until the last minute.

The employer has made factualy incorrect comments about me but I have not given any statement for myself, do I have a right to reply as I will be in attendance or can I produce a statement or letter before the actual hearing to respond to the allegations?

Hello

I take it the someone you know is not legally represented?

Were both sides directed to exchange statements? As you say the other side 'delayed.'

When is the hearing?

Did both sides agree a bundle?

Are you attending as a witness? As in has the tribunal been informed you will be giving evidence?

The person is a relative and I am attending in support, they have got a solicitor but haven't had a chance to contact him and am away on business so it will be difficult as the tribunal is friday and they only passed their statements on Friday gone.

The claim is due to dissmissal folowing a making a claim for personal injury.

Heres the story:

I went to collect my relative following the injury and the circumstances were told to me by a manager and another staff member. When contacting the business on my relatives behalf I spoke to various staff on the phone and when they asked what happened I told them what the other staff have told me. They have accuesed me of trying to influence other staff members in my relatives favour.

One staff member has also made a statement saying they heard me in the background of a personal call making comments about the events influencing my relatives version but not stating what I am supposed to have said. Which was actually advising my relative that they shouldn't discuss the matter with this person, whom they thought was a friend, as they didn't know if they could be trusted.

They have also made personal attacks on my relative and are stating things going back several months, which I feel I can comment on due to conversations I have been part of with people from the business.

I know this is a bit vgue but I don't know if the other side may be reading so I will PM you with more detail if you would be kind enough to help.

We do not advise giving or accepting help via PM.
You will have no way of knowing if the advice you get is good or if it will jeopardize your claim.
If the information is given on open forum, then, if the info is bad, someone will be able to correct it.

If you stck to your user ID and not use personal details, then nobody else will know who you are.

In that case I'm sure the solicitor has a safe pair of hands.
It is quite normal to exchange bundles, statements, etc just a week before.

And no doubt you have been nominated as a witness to the tribunal and not just to attend.

You will be able to get off your chest what is troubling you next Friday.

By all means, yes.
Only if you are there as a witness will you get the opportunity to speak.
If you are there as an observer, you are just that and not allowed to speak.
