Default Please read this im really worried

Hey!
I started a new job in march and it wasnt working out so i resigned last friday so worked for them for 2 months, i took 5 days holiday witch was paid to me, now i had a phone call from my exboss telling me i have to repay them, and hell take me to court now by my reckoning i occured 1.5 days holiday per month i worked eqauling 3 days plus worked a bank hol so i occured 1 day making 4 entitled to, so owing them 1 day which roughly works out to 35 pounds. he said ill recieve a letter through the post saying i owe 5 days pay thats not right is it? i dont want to go to court any advice would be great

Hi Carlyann,

Firstly do not worry, very unlikely that your ex boss would go to court over such small sums, he is just trying to bully you. Having said that you may have to pay something back but more info is needed as follows

How many hours per week were you working, over how many days ? this is important to correctly work out your holiday entitlement.

Did you receive a "contract of employment" and if so did this say how your holiday would be paid and when ? with regard to Bank Holidays

Hi Carlyann,

I dont mind you sending PM, but I think that it is best kept in the open forum so that if I tell you anything wrong, it can be monitored and corrected.

From what you have told me you worked 5 days per week, this would entitle you to 24 days holiday per annum (4.8 Wks x 5 Days). So that is accruing at 2 days per month. Therefore your assumption is correct and you have been overpaid by 1 Day for your holiday entitelment.

So I think you need to wait for the letter to arrive and clarify why your ex boss requires 5 days paid back. At the moment I see no grounds for such a claim.
