Insolvent Employer wont pay out

I may be posting this in the wrong section but I hope someone can help me.

I recently went to an employment triburnal agaisnt my former employer. As I imagined they did not turn up and have offered no defense for their actions since I applied at the triburnal. They have made it known to me though that they would not be paying out on anything I won at the triburnal.

I have since found out that they have made there limited company insolvent and I have been told that I wont be able to claim any of the money awarded to me by the judge.

This is really annoying me as they both are basicly laughing at me knowing that they will not have to pay out this money. Is there anyway to claim the money from themselves rather than the company as both have the money to pay out?

The only way that I know of is if you can prove in court that they were not running their company in a correct manner - this may prove very costly.

If you can prove this, you can then move to hit their personal assets, but you are talking about high court orders which aren't cheap, I know as I have just paid for two. If you are willing to go down this route, you can claim 8% interest on the money they owe you until you get it but the legal process involved isn't quick, and it could take a years to get your money. Only you can decide whether you can be bothered with the stress and if it is financially worth it or if you just want to cut your losses and move on.

Sorry to be the bearer of bad news, I know how annoying this is. This is a fine example of another disgusting tactic used by limited companies to dodge their debts. Most of the time if the insolvency is investigated the authorities will find that on paper, everything looks fine and you may find the authorities reluctant to investigate unless there are glaring fruadulent activities.

If they are a limited company their details will be on Companies house website. Look up their name and see if they have appointed a liquidater to close their business. If they have then get in touch with them and state your claim.
