after reading your advice and responses i see that you are highly regarded in the employment and disability field.
my case is a tough one i have just been diagnosed by a top pschologist who does tribunal medical reports and has written publications for the DWP on occasions, as having contracted PTSD from my problems at work which go back nearly four years now.
my GP notified my employers that he thought yes that i was disabled under the DDA.
my case is bullying and harrassment for the past 4 years and my employer/s have done nothing about it.
the work i do is connected with the job centre through a contractor so comes under a public authority.
I have again been told last week that my employers ( for the second time) are giving up their contract and so i am being transfered again under tupe 2006 regs to a different company.
if i go back a little.
the first employers obv knew that i was taking them to a tribunal so gave up their contract so this case transfered to the new employers.
this went to a tribunal last march and was struck out for the first employer has being out of time, but the chairman advised that i should resubmit an et1 for the new respondents which i did and we have a full hearing in 3 months time.
now because they are giving their contract up to the new employers the liabilities go as well which means as with the last employer that they get away with what they have done to me scott free.
this to me is a case of passing the buck. these employers have the best lawyers in the country and i am really struggling.
the manager who caused the problems last year as been transfered as well and no action whatsoever was taken against her ( mainly because i think she was a share holder)
i dont know what to do but this has been like out of the frying pan and into the fire, now its out of the fire and into the furnace!!
i really cant take anymore can you help please?

| | Gold Account Customer | Re: serious problem needs your advice,DDA,PTSD As your firm is transferring their liability to another organization I feel that this would come under TUPE, and the new organisation would have to take over all employees problems as well.
Not sure but if I were you I would see advice with an union if you are in one or go to a solicitors for advices it would be work it in the end and save you a lot of worry.
Also look up the law on TUPE or contact ACAS
Hopefully someone that is more acknowledgeable than me will come along with some help for you. Also maybe you will be entitled to legal aid and a solicitor will tell you if you are but you can also look this up on the net as well.  |
