I had a default notice from Egg which has expired and I now have a notice of intended litigation from Moorcroft Debt Recovery Limited. I am in the hands of a claims company who say don't worry forget about it - should I ? What happens next.

I take it "I am in the hands of a claims company" means you are using a fee-charging intermediary to reclaim your penalty charges.

Egg does not make a song and dance resisting charges reclaim provided you follow the well-blaized trail, paying out promptly in the majority of claims.

Your outstanding card balance less charges refund is lawfully enforceable, and yourself not your intermediary can be hauled into county court to face a CCJ. Or you could consult Citizens Advice and other voluntary organisations to negotiate affordable monthly payments with Moorcroft and avoid the extremity of a CCJ staying on Experian for 6 years -- much worse than a Default Notice. As to whether Moorcroft is bluffing, you could:

click SEARCH in the top blue bar
clich ADVANCED SEARCH
set keyword to Moorcroft in the thread title only,
restrict the search to Egg forum if you wish.

The threads returned will give you some indication whether Moorcroft is intending to bark or to bite. Suggest you start a new thread "Hopster v Moorcroft, Egg - CCJ" where your posts will receive more attention and replies."

I wonder if anyone can help-I had a visit from a Home Collections agent from Moorcroft re an egg card debt. I wasn't in but he posted a card through the door in an open envelope. My husband saw it and there were angry words. I phoned this man to complain but he said he sealed it-the envelope was obviously not anything of the sort -the seal was totally unused and my husband has not opened any of my letters in 15 years of marriage. He said I could only deal with him now and not head office-I am scared stiff of him coming to my house again. any advice would be helpful

Please start a thread "Bodgerella v Moorcroft & Egg" where you will receive better attention. This thread about Egg's contact address has been hijacked twice in one day.

You cannot put the fear of God into the Moorcroft runner, but you can put the fear of God into the Moorcroft Company Secretary and legal representative answerable to the court and their licensing regulator.

Go to Companies House where possibly at a cost of £5 you will be able to look up Moorcroft's board of directors. There you will find the name and private address of the comp. sec. You then write a letter to him, possibly registered to impress on him the seriousness, that you will not accept intimidatory visits from strangers, and that all matters re arrears need to be dealt with in writing as per guidelines laid down by OFT, Moorcroft's annual licensor. Suggest you make clear in this letter that you are sending a copy to the OFT, which has a licensing office in west London.

If having been thus warned Moorcroft Comp. Sec. charges forward regardless, they will look like defying their licensor. That's the big stick. Suggest you also offer a carrot to Moorcroft, of monthly payments within what you can afford, as demonstrated by income and expenditure sheet. To negotiate a settlement, why not pay the Citizens Advice Bureau a visit?

Not to be scared of Moorcroft. They are scared of you too. Good luck.
