I really like the bit Quote:
card repayment protection was applied to your Egg Card following a phone call on 9th July 2004 in which you agreed to take out this product.
Due to this I'm unable to refund any charges applied to your Egg Card. Oh, ok then - of course I believe you... | I would definately make an S.A.R - (Subject Access Request) and CCA 1974 requesting a copy of your original executed signed Agreement. They have to PROVE you asked for it.
CCA Request Quote:
REQUEST UNDER THE CONSUMER CREDIT ACT 1974
Dear Sir/Madam
ACCOUNT NUMBER: XXXX XXXX XXXX XXXX
With reference to the above agreement, I require you to supply the following documentation.
You must supply me with a true copy of the alleged agreement. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account.
You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.
I enclose a payment of £1.00 that represents the fee payable under the Consumer Credit Act.
| Once you gone down the official route and the account is in dispute they can't hassle you until the matter is resolved.
Send them a S.A.R - (Subject Access Request) to enquire about the charges and send them a CCA request to enquire about the PPI.
Non-compliance is taken very seriously by the Information Commissioners office.
I'd go and have a good read through the PPI section and gather as much information to help you as possible.
good luck |
