Angry Pezza 76 v Egg

Just to update you all

In October I sent a Egg a letter asking them to supply me with a copy of the default notice they 'apparently' sent to me three years ago. I enclosed a £1 postal order, and to my amazement they just completely ignored the letter, despite the fact that I had proof that it was signed for. So I rung them and explained the situation and was told they don't have to supply me with anything.

So I thought change of tactics are called for! In November I sent a Subject Access Request request to them. I have changed addresses since I last had anything to do with Egg and put that on the request, and as expected the standard Prove who you are blah blah blah was sent back. It was sent back at the most inconvienent time for me as our baby was due, it was christmas and my office is closed over xmas. Anyway they said I had 28 days other wise the case would be closed, to my surprise after 20 days I received a letter and my £10 cheque saying the case was now closed as I hadn't responded!! What happened to the other 8 days?

So once again I sent another Subject Access Request request on 19th January with another £10 cheque and a letter from my employer to confirm who I am. I put in the letter they had 28 days to send through all of my data, as they are a massive organisation and if they expect me to get things done in 28 days, then the same surely is expected from them? Anyway a couple of days later a letter came through saying they had received my request and that they now have 40 days??!! do they make there own rules up? Anyway it is now the 40th day since my request and nothing, oh apart from my £10 cheque was cashed weeks ago.

Is anyone in the same predicament and what should I do next? I'm thoroughly p'd off with them!!

At first it wasn't about the charges it was about the default, but now I want to get everything back and my default removed.

My account was settled 3 years ago so I have no outstanding debt with them.

*Update*

1st March - Finally received my Data through!! After 43 days, I think the fact that I kept chasing them by email helped.

As you will see if you read through the above post, I sent them a letter in November asking for a copy of my default notice, that they didn't even bother to acknowledge. Anyway reading through my files there is a screen shot from 28th November that states that they have received a letter from me asking for a copy of my default notice and qouting the CCA 1974 and that they didn't know what to do, so they just ignored me! Is this legal?

Any ones advice would be greatfully accepted!! As I seem to be talking to myself at the moment

8th March - Blah blah blah usual standard reply saying that their charges are fair and they will refund me £116 (you exceeded your limit 14 times, due in no small part to the payment protection I never actually requested, failed to make a payment 15 times, as I was struggling to keep up with my payments you thought it wise to keep adding on charges which meant more interest) the difference between the £20 charges and the recommended £16 by OFT.

Letter will be going back saying I accept the £116 as part payment, but I will still keeping going until they have given me back the rest of my money and removed the default on my account.

If they had removed my default when I initially asked it would have saved them paying me out. That's all I wanted as it has caused me no end of grief.

They have definitely gone downhill in a big way. As per my comments on a few other posts I used to work Prudential and Egg started going wrong when the Pru made it 100% Pru owned again. Tried to make it more profitable by synergies across business'. Got worse and since sh!tt!bank took over they've gone to the dogs.

I was in the same scenario getting worse off by being hit by charge on charge. Soul destroying.

I hope you manage to get all sorted really soon

Update - sent LBA on 14th March and it is now the 28th so I will be starting the Money claim process tomorrow. I even sent them a reminder by secure message on Tuesday and they have still chosen to ignore the deadline.

Update -

11th April after having my LBA completely ignored by Egg I have issued my claim on MCOL.

Claim Number is 7QZ49643

Just a case of waiting now!!! Is anyone else at the same point as me?

Have rececieved through acknowledgement from court, Eversheds are now dealing with my case and intend to fully defend.

How far is it normally going with Egg at the moment? All the way to court?

Update - Have received a letter through from Eversheds today offering me £400 in refunded charges and £80 for legal costs. This is roughly 1/2 of what my claim was. I am going to send a letter back accepting the £480 as part payment but saying I am still claiming for the outstanding part of my claim. Is there a template for accepting part payments?
