Default Egg Play Dirty

After Sending Lba I Have Received Letter From Egg - Firstly Stating They Hadn't Received My Prelim Letter - Funny That As I Sent It By Recorded Delivery And Have The Printed Proof Of Signature From The Post Office. Secondly What A Surprise They Are Disputing My Claim (which Was For Late Charges, Exceeded Limit Fees And Ppi Which I Never Agreed To - They Say I Did In A Telephone Conversation In Dec 04 - I Asked For Proof And They Said They Can't Provide It), So I Rfeceived A Letter Off Them Basically Telling Me That If I Took Court Action With Regard To My Old Credit Card Account, They Would Call In My Loan To Them Which Is Roughly About £2,000.00 To Be Paid Within 28 Days - Nice Eh! Dirty Trick Egg - Shame On You. So I Have No Choice - I Can't Afford The £2,000.00 At The Moment So Will Have To Discontinue Claim - It Was Only For £300.00 - Seems To Me Egg Are Hellbent On Defending All Claims Against Them. I Hope That Someone Cracks This One Soon.

They cant do this if your payments are uptodate. The only way they can recall the loan within 28 days is if you are in default with payments. They are trying to bully you.

Hi Stansfield5131 -my payments are uptodate - I have a direct debit set up - never missed a payment yet - was shocked when I got the letter saying that - they are bullys, you are right about that!

Continue with your plans to claim back your unlawful bank charges and take not notice. They cannot do this and they know it!!! Dont let them bully you into dropping your claim.

You need to contact Trading Standards on Monday and fax them a copy of the letter for their advice.

Firstly you have evidence that they recieved your prelim letter so I wouldnt worry about that point.
The threat to call in a totally seperate loan is a threat to make you drop your legitimate claim. What is the worst they can do if you continue? they will have to issue a default before they do anything else which will be a direct contravention of the CCA as your payments are fully up to date. Then they will have to issue a summons in the county court. That you can immediately argue is retaliatory action, which the court will definitely not like.

I, personally, would be even more determined to fight them if they made this threat against me.

I would write to them pointing out that their proposed action is retaliatory and designed to avoid refunding a legitimate claim for unlawful charges, give them 7 days to reply and then issue a moneyclaim.

They are not defending this claim they are trying to avoid it to minimise their costs. Ignore their pathetic threats and go get them They will back down as they dont have a defence to the claim and they know this sort of action will only land them in deeper water.

Egg are already in trouble with me over my Subject Access Request

I'll be watching this thread and be ready to help in any way I can.
