Hello,

My hubby has a claim against Egg for charges and they are counterclaiming for costs incurred when they made him close his credit card account and repay the balance. The court date is Tuesday and it looks like they are intending to turn up!!
Yikes...hubby is not interested as he has let me write all letters and file claim etc but will not go to court. Do you think Egg will turn up? Has anyone faced them in court yet?

Unfortunatley, Egg seem to be sending a rather good barrister along to a lot of their hearings.

Think you should take some advice from others who have already been there.

From what I have seen, they will try every trick in the book.

It obiviously makes sense for them to go to hearings but whether they are a good barrister or not only time will tell - plus they have to have the law on their side! and they haven't, so it seems.
Even the best barrister in the world can't make a silk purse out of a sow's ear.

They turned up to Yasmin's original hearing, a Barrister Mr David st Clare Nelson and his assistant, though that was in London.

I have just had a call at 6.15 asking if they could do case over the phone , they must be thin on the ground anyone else had this experience he threatened me with their costs. I have said I do not agree as I have taken time from work any advice...It looks like they are thin on the ground

Their counterclaim was for £120 which was their 'costs' of having to close my account (retaliation).

As you didnt attend i dont suppose you know how they broke down this claim.

The reason i ask is because i used to have an egg account which i defaulted on. But is now cleared.
Im currently waiting for my S.A.R - (Subject Access Request) documents.

I imagine they will try the same thing with me, and try to counterclaim for closing the account.

Also, now that judgement has been made in Egg's favour, does that mean you have a CCJ on your record? (unless you pay in 28 days) ofcourse.

Hi,

I had never defaulted on my account. I put in a claim then was about to pay off the card and close the account anyway when they sent me a letter demanding i repaid the account as they were terminating my agreement.
Apparently their costs for doing this were £120.

Have you written to the Judge/Court, explaining as to why you could not attend.
I feel sure that if you were able to provide a VALID reason/explanation for non attendance to the Judge, then perhaps? you may be able to get another hearing.
