| Help Please - Egg brick wall I can't get info re charges from Egg. Brief summary :
'24/04/04 Sarn request plus £10
'13/05/06 Acknowledgement but asked for I.D. proof
'18/05/06 I.D. sent
'09/06/06 Acknowledged and originals returned. Confirmed they would send the info within 40 days.
Nothing received.
14/08/06 Complaint to the Information Commissioners Office. I thought this would force Egg to comply.
Information Commissioners Office response today. They will instruct Egg to send the info within 14 days. they will inform Egg they are in breach of the Act and request an explanation. BUT the case and file is now closed ie it was an open and shut case of non-compliance.
BUT what happens if I still don't get the info from Egg ? The Information Commissioners Office have now done what they can ie tell Egg to comply. What happens if they don't ? What do I do then ?

Still now you dont really have any choice but to wait, for the fourteen days.
However, fourteen days just happens to be twice seven days.
Id sent them a non complaince letter telling them you intend to proseucte, followed in seven days by an lba then if they dont supply theinof within 14 days as per the Information Commissioners Office letter instigate court proceedings immediately.

After the 14 days how do I take them to court ? What I mean is I've already done a moneyclaim against Lloyds so I understand that process. Do I do a moneyclaim but specifying no amounts etc - just failure to provide info ?

You can only use MCOL if you are claiming money.
You can download, or collect from your local court the N1 form. Complete it and send / take it to your County Court with the fee (£150 ISTR).

Thanks | Hi its all in the FAqs Egg are very difficult they think they are a law unto themselves. Read Mcuths thread ref egg also bigcol.

thanks but this claim is for non-complaince with Sec 7 Data Protection Act and before you go waltzing to the court with £150 do yourself a favour and check out Oddfellows claim which i believe was for costs only in the end of £30.
It was for an order, it is filed on an N1 and IIRC he put down a nominal value of £5 or something, note order not injunction, and the fee was im sure £30.
