Perhaps send along with that identification the fact that they must adhere to your deadline, that they have however man days left, that you will ( ) issue a court claim against them for compliance if they do not provide the requested information, just so that they preemptively know you're not a pushover

A bit slow with my update but here goes; I received my info from Egg and sent my preliminary request for £340.00. I have just received a fairly threatening reply from Egg but having read a few of the Egg threads (angry cat, mcuth) I shouldn't be surprised. There are six points in their reply, mainly the usual terms and conditions stuff, but points 4 and 5 are their attempts at scare tactics.

4. We should also point out that it is Egg's policy to terminate the account of any customer where, in Egg's view, the bank/customer relationship has irretrievably broken down, for example, where a customer issues legal proceedings against Egg on the basis of a disagreement over Egg's standard terms and conditions. If you do wish to take this matter further then we suggest you consider seeking independent legal advice.

5. Where a customer's account has been terminated, the customer is obliged to repay all outstanding amounts due and owing to Egg within 30 days. Where amounts remain outstanding beyond this period, Egg will consider taking legal proceedings for repayment of the outstanding sums. Where the termination is done by reason of the customer issuing legal proceedings against Egg such legal proceedings are likely to take the form of a counterclaim. Any adverse result to the customer under legal proceedings to recover moneys owed will ultimately lead to a county court judgement being registered against the customer (which could affect future credit status).

Have read Bankfodder's 'counter claims' post so not to worried and as for outstanding amounts being paid within 30 days, do they not have to give you a reasonable time?

One point I have on this and it's just a thought. If they do cancel then surely the consumer credit act no longer applies and it becomes civil debt. If you then rigth back offer a reasonable repayment plan then they should accept (unless they think a Court will award more). However they cannot charge high interest rate just normal 8% etc ? Much cheaper way to pay back the money.

cheers Daz, that's what I thought. In a similar position with my A&l current account. They closed the account after my claim but I had some overdraft to clear. They started sending me letters saying pay within 7 days or we'll start legal action. However, they haven't started action as I have been making regular payments (although not agreed payments) every month.
