Default CCA'd Egg!!

Greetings all, I CCA'd Egg on 27 October and received back an electronic version of my CCA dated October 2006 with the tick by my signature. They also sent me screen shots of document entitled 'Legal information you need to be aware of'. I guess CCA is enforceable - no scanner at mo to upload. As they didn't send me any statements etc, I've written back saying they are in default. Not sure if this is wrong or not but since I CCA'd them I'm overdue with my last payment. They are calling a few times a day, texting and have written telling me I'm behind. Does anyone have any suggestions please? Should I make them an offer in the meantime as I can no longer afford the payments?

Subject Access Request is separate from CCA request, and needs to be accompanied by a £10 payment (Egg also offers a faster-turnround slimline list of your penalty charges with dates and amounts, for £5 from you. The alternative is an one-inch thick pile of papers taking up to 6 weeks to arrive.)

The charges list will be sufficient for making an unlawful penalty charges reclaim. You will probably be asked to supply a photocopy of passport or drivers licence, plus an original utility bill to prove you are who you say you are. So it will save another exchange of letters if you include the above with your £5 or £10. Nowadays Egg does not put up any serious resistance to reclaims.

Once your reclaim is under way, you can tell the phone chasers that your balance outstanding will be shortly reduced by Egg repayment, and thus tone down their screaming urgency. If you are going to propose monthly repayments, then obviously such an amount could be reduced, considering the lower total outstanding.

Ah, thanks for that. I may have got it wrong then. When I CCA'd them I thought I was supposed to get back more documents than just the electronic CCA and the Legal Information pages. If I've paid any charges it will only be in the last month or two so it won't reduce the amount owed by much. I was just hoping they wouldn't come up with an enforceable CCA.
