Default Mrs Chips v Egg

Hello,

I was wondering if anyone can help.

I have written to Egg with a budget statement offering a token payment. I have never heard back from them in writing regarding this, although they have cashed my cheques.
They are ringing me 5-10 times a day, despite the fact that I have written to them twice regarding harrassment (using the template letter from this site). On both occasions they stopped ringing for 3 days, and then the phone calls started up again.

I have also written and asked for a list of all the charges applied to the account, so will claim those back.

My question is - what is the next step regarding the harrassment? Do I now make a complaint to the OFT? They wrote to me with a standard 'sorry you've had to complain letter' which stated I had to wait 8 weeks to complain to the OFT - is this true?

Hi mrs chips. Have you asked for your CCA? Does it say on the bottom of your letter "This is a final response"? Normally if they tell you it is a final response you have to refer the matter to the authorities within 8 weeks. You don't have to wait for 8 weeks to complain. I don't know if I'm right in saying (someone please correct me if I am wrong) that the OFT do not respond to individual complaints. You could always try to complain under CPUT (Consumer Protection from Unfair Trading) 2008. If it was me I would be requesting a copy of your original credit agreement- is it a loan or credit card and when was it taken out? As for the phone calls there is a way of blocking certain numbers, you would have to speak to your telecom provider. Just don't answer their security questions and they can't discuss it with you- if they do they have broken the Data Protection Act and would be in even bigger trouble! Hope this helps

Thanks for the reply. They have finally stopped calling me...but I have a new problem!

They have sent me a default letter - saying that they had not heard from me. I have sent all my letters offering reduced payments & requesting a freeze of interest recorded delivery & they have signed for them. they have also cashed my cheques. I have however had no response in writing from them.

What I really want is for them to freeze interest. With other credit cards I have had when they have sold them on this is what has happened. Does anyone have any experience with Egg as to whether they are likely to sell the debt on or not?
Ideally I don't want to default as I have been improving my credit rating over the last 2 years (apart from this spat with Egg) and will be back to square one.

I wrote to them yesterday offering 25% in full and final settlement. I doubt they'll accept this though.

I have just written a CCA letter which I'll post later but from what I read on here Egg CCA's are pretty watertight. I've also started the process to reclaim charges from them.

They have said that I need to pay the arrears to stop them defaulting me within 28 days. I can probably make this payment if I have to. Could anyone advise me as to what would be the best course of action?
