Default DVLA, Court Case Re Cloned Vehicle

Dear All,

I received a letter from the dvla saying my van had been spotted with no road tax. They wanted to fine me £60 for this, or would take me to court to recover the money.
The van that they had spotted was a cloned van, I have spoken to the police at the imformation compliance dept and the vehicle crime intelligence service and they pulled up the information on the pnc and confirmed this.
Still the dvla wanted there money.
Last week, i attended court. There were 3 magistrates, 1 clark, 1 court lawer, the comunity police officer, 1 member from the dvla and me. After the hearing everyone present realised I was not guilty and the dvla have now been given time to check out my evidence before a new hearing.
I am not guilty.
But this has cost me a fair sum off money, can I recover my cost from the dvla?

Have you got a solicitor ? So the case has been adjourned ?

The Court has the powers to order costs against you or the other side-and in most cases always do.
You will be given opportunity to ask for costs,and this is decided at the prelude to the case.

Retail Loss Prevention-assisting 2 victims.

Christmas has gone but......the mission goes on.
Wishing all a great year in 2009-and hope everyone gets ALL their charges back..and justice for any other issues that come your way.

If you can show the DVLA has acted vexatiously (you showed your van was cloned and they still took you to court) you can ask for compensation. At court ask for the duty solicitor and request £5000, let him work down from there.

Im pretty sure the case was adjorned and I was given a second hearing date.
I did bring claiming costs back up at the hearing, the solicitor said I can only claim travel costs and lunch. No loss of earnings. At this court.

That sounds like a criminal proceeding. You will need to start a civil action to recover your losses. You will need a solicitor because taking the DVLA to court is messy.
