hey guys, im rob and new to the forums. Im posting here out of almost desperation. (i dont know is this is the right thread or not sorry)

anyway my story - -

About 2 years ago i purchased a motorbike from a small dealer in wigan. I payed cash for the bike Just over £1200 infact.

few days ago i come to sell the bike on ebay and one person asks for the reg' to do a HPI check. he came back to me saying - "didnt know if u new about this but this came back to me
There is an existing finance agreement/loan recorded against this bike.

Now, when i purchased the bike, i was not told by the dealer anything about exisiting loans/agreements i didnt even know u could sell whilst in an agreement..

I ring black horse and after speaking to 4 different people one woman asks me "do i have a recipt, im like erm its 2 years ago but ill look. THey want me to fax it... But,, i cant find my recipt.. I dont know what to do, i dont know where to look or who to turn to. I really hope somebody has some knowlege in this area, if so please do share.

Why don't you go back to the dealer who sold it to you to clear up this mess?

that is one option i have, but im thinking as i cant find my recipt he have shoulder me off and want nothing to do with it or he might just lie about selling it to me in the first place. the log books previous owner isnt even the dealers address or in the name of him :s

The previous keeper (not owner) on the V5 is probably the guy who sold it to the dealer with outstanding finance.

A dealer does not have to register the vehicle to himself. However, a dealer is held to be a professional person and is responsible for checking outstanding finance, etc.

As you have purchased from a dealer and you had no knowledge of the outstanding finance, you have good title. There is no requirement for you to have had an HPI check done.

One last point. Black Horse are known for wrongly registering an interest on HPI for vehicles bought with a personal loan rather than HP. The HPI check that has been done, shows this. It is not a bar to selling/buying as the loan is not secured on the bike. The dealer is not at fault, as there is no outstanding finance on the bike; Black Horse are wrong.

You will need to write to Black Horse, quoting the details from the HPI check, and demand that they remove the wrongly placed flag on your vehicle.
