Our private details are supposed to be protected under the data protection act aren't they? Can the DVLA sell on our details to third parties without our consent?

No unfortunately they are not breaking any laws. This stupid government have given them (as all gov depts), the power to raise money. There is legislation that says that it can be sold to 'need-to-know' people, that includes not only lawful requests from the likes of the police, but comic companies like private parking comps as well, and in fact any Tom, Dick or Harry, all you need is to send them some reason, made up, lies or just nosey.

It irks me more that they are profiting from our details, surely they should be paying a royalty to every addressee whose details they sell.

My 'friend' is currently waiting for a court case listing to go ahead where my 'friend' refused to inform DVLA of a change of address for both DL and VE, the defence is that my 'friend' objects to personal details to be SOLD on to companies who are NOT government agencies and use the information for profitable gain so therefore refused to inform the changes on the ground that it may lead to a breach of Article 8 of the ECHR Act 1998 'Right to respect of Private and Family Life'

It has had its day in the local mags, and was sent to the Crown awaiting mention.

That could be taken as a deliberate attempt at fraud (if that's the right word), as the people at the old address will get any parking / speeding or other violation tickets.

Not necessarily. As long as Hobbie's "friend" can still be contacted at the old address i.e. his mail forwarded on, he has not committed any offence. The people at his/her old address will, I assume not be called "Hobbie", therefore will not be liable.

No attempted fraud, no conspiracy to defraud, no attempts or acts have been committed.

He does not and has not evaded responsibility for the vehicle, or any lawful PCN's issued against it, his 'fight' is that the law currently states he must inform a government executive agency of any changes or face a £1,000 "fine". But it does not say within the legislation that the information will or may be sold and be used for profitable gain by NGO's.

Nor does it state that he will be compensated for any profit the DoT earn on selling of his personal data.

If I can just clear something up here too, it is not myself under the guise of a 'friend', the mags court tilted on the verge of caution and stopped just prior to saying it was illegal to sell the information without an opt-out but instead decided that the crown should decide if or if not what the DVLA do is legal or illegal.

It is listed for mention in August 2008, If my friend wants the case to be publicised I'll give name and location later.

My old mortgage company traced me through DVLA records.... long time ago now.

Bottom line... don't trust the Government... any company run by them, or any institution which employs their members as exec. or non-exec. directors (banks, etc).

The AA think it's a scam and I haven't seen them taken to court for libel for saying this:

'Scam' has many connotations. To me it means a manipulation to the detriment of another, but not necessarily illegal. As for one pseudo-government body suing a registered charity (AA Foundation) what would be the point?

Also, by providing the details to a third party, DVLA have received a statement that the requestor has 'reasonable grounds' to request the information. They release the information on that basis. Saying this is aiding and abetting it stretching credulity to it's limits.
