I was in court yesterday for having been sent a summons for no tax on my car. While i was waiting outside the court i noticed that the local renta bobby had not filled the form correctly that was sent to DVLA. In the ticket that is sent off has a box asking. "Occupation" which the renta bobby had left it blank.
Now the same renta nobby had came round the day before and put a same ticket to my partners car for no tax too. but had filled out all the box's and put down in the occupation box "pc and his number"
Now i did point this out to the prosecutioner before entering court, and he was very quick to say that it small mistake, and could if need be ask the court to re summit the form correctly filled out or ask the renta nobby to be in person in court as a witness instead of the form. He also said "its a small mistake and its not likely the guy had forgotten his occupation"
The thing is i pleaded guilty before noticing the form.
DVLA wanted £11.47 in back pay of road tax and £45 court cost and a fine.
Would this form been thrown out of court for a technicality ?????

No.

There is a thing called the "Slip Rule" which can be used top correct minor mistakes that are not essential to the prosecution of the case. Like your example; misplaced letter in name or address; incorrect post code, etc.

I very much doubt it, but since you pleaded guilty - and quite right that you did so - what difference would it make now?

I presume you do agree that your road tax should be paid? Take the fine on the chin and remember to pay on time to avoid future court costs - that's probably the best advice I could give you.

LOL I was guilty.... no doubt about that i will take it on the chin as you put it as it would probably long painfully process for a small return. It would be nice to know that i could if i wanted to challenge it tho.
its just the sneaky renta bobby could have seen that the car had only run out of tax for 10 day and that if we taxed the car that month would have paid for the 10 days missing as you pay for a full month!
