Cool dvla refused to give tax refund

i recentley road taxed an old car so that i could transfer the reg no to my new car , after applying for the number transfer the vehicle being taxed for a month i sent the disc back fo a refund , weeks went by without any word from them , i telephoned them twice , was told its being delt with , eight weeks after sending the disc they send a letter to say no refund because a new disc had been issued at time of number transfer , my position here is that they had had my tax disc for 4 week before issuing other one i did not want a new tax disc i had scraped the car and returned the red doc by this time , i wanted a refund for 5 months road tax , i wrote them a letter but no reply , i now want to take them to small claims court to get my refund , any help please

You applied for and received a tax disc for vehicle registration ABC 123.

You then transferred that VRM to another vehicle. When this is done, the original vehicle will be issued with a tax disc showing its new VRM. The tax disc (that they ask to be returned, BTW) bearing ABC 123 is voided.

If you want to reclaim any VED refund, you must use the new tax disc bearing the new number. You shouldn't have to wait for it - it should be issued with the transfer authority - only the V5 has to come later from the DVLA

You seem to have tried to encash a Tax Disc that has already been replaced. This one should have been returned to the DVLA in the brown envelope at the time the transfer was completed. The only licence you can get a refund on is for the vehicle's current registration and Make - the original disc has no value as it doesn't refer to anything that is on the road.
