Default DVLA causing us a headache ---help

my husband sold a car just before christmas when he got a company car. our car had a private plate when we sold it to a dealer. filled in all the paperwork from our V5 doc... including the paperwork to retain the private plate. recieved letter saying thank you for notifying us of the sale ect...got retention papers ect... 2 months ago recieved letter from DVLA to say that we are going to be fined for not informing them of the sale of the vehicle...description of car correct but new registration details..(assumed new number issued when retained private plate).rang them straight away...said to write in so did so...said not good enough should have sent another tear off slip from new V5 showing new registration number after retaining private plate...how could we do this when no form came to us with new reg number and we had sold it already....are we in the wrong do we need to pay the £80.00 fine?

you would have thought so wouldnt you. DVLA's letter to us basically said we should have applied for the retention first waited for the new registration before we sold it! we assumed the dealer knew what he was doing when he gave us the relevant sections to fill in...he sold the car to another dealer on the same day we sold it to him would you beleive. we contacted our buyer and he said ignore it its a DVLA blip...but hes not the one being asked to pay the fine !

The forms for both retention and transfer make it very clear that you should not dispose of the vehicle before the retention/transfer is complete. This means waiting for the new V5.

thank you for the informaiton patdavies. i had no idea that was the case. we relied on the information provided by the dealer who bought the car..guess we will have to pay the fine before they take court action.
