Default NCP/DVLA refund issue

I had one of my cars moved from the public highway for no tax on the 16th July 2007. It was completely my fault. The car had a CV joint that was a little noisey and I thought I would repair it when I could afford it so I didnt renew the tax and infact SORN'd it off the road. I accept that I was in the worng as I had left it on the road.

First thing on the 17th I paid the pound £200, £80 penalty and £120 surety fee. Before paying the fee I specifically asked that the cheque be made out to myself as my wife doesnt have a bank account (the car is in her name) and they made a note of this on my file and said there was no problem in doing this.I promptly had the car MOT'd and taxed that day (didnt actually realise the MOT had expired until I tried to tax the car !) and on the 23rd July. I returned to the pound and showed them my Tax disc. I was told that I would receive a cheque in 14 days. Around the 19th August the cheque still hadnt turned up so I rang the pound to enquire as to where my cheque was. The response was that it had been sent and they could only assume that it was lost in the post. They said it would be sent out and the original be cancelled. Again I specifically asked for the cheque to be made out in my name. Today a cheque was received in my wifes name ! Furious that it has taken 6 weeks and is still wrong I get back onto the phone to the same woman that has dealt with at the carpound and she remembers the issues ! She states that the note on the file is still there and this was not acceptable. She said to give her 5 mins and she would ring the headoffice and get this sorted out !

5 mins later she is stating that headoffice will not send another cheque as my wife signed the owner/release agreement and it states in the terms that the cheque will be going back to her !

I have since rang their headoffice to be told the same and they are not willing to budge as I should have read the terms and conditions. There solution to this was for my wife to cash the cheque at one of the cheque converter stores. I did ask if they were prepared to pay the handling fee that these companies charge and they said no !

Have I screwed up by not reading the t&c or can I get said cheque re-written in my name. I really am fuming mad.

Pragmatically, I would add your wife to your bank account or open a building society joint account - they will accept the deposit of a cheque made out the her.
