DVLA fining me no SORN on a car they admit I don't own.

I sold my business with the van in June 2006, the DVLA wrote to me in November 2006 saying I didn't TAX it. I replied supplying the evidence and they replied saying they had updated their records to show I ceased to be the owner in June 2006.

To my amazment I then get a letter of a debt collection agency for the unpaid fine, I have appealed through the DVLA all the way and the only response I get babbles on about continuous registration legislation and basically I have to pay someone elses fine.

I have told them to sue me but will they and even can they?

Yes, they will take this to court. The question is what action did you take at the time you sold the van with regards to informing DVLA? Did you send back the V5 at that time?

I certainly did but they say they didn't get it. I guess I can't prove I did but they can't prove i didn't.

I just can't see how the hell can charge me a fine on a vehicle 5 months after they agree I sold it.

The DVLA are a constant source of amusement. They always use this argument that they never receive it, but if you ever get your road tax online and it gets lost in the post they will tell you that the post service is not guarenteed.
