Default Cancer Patient fighting SPML repossession

Hi

I have been dealing with SPML for 6 months and told them about my illness and they totally ignored me. They have not followed FSA guidelines and have no plan in place for people like us and they say we do not fit their criteria. If we don't who does?? We are now going to court because SPML cannot make a decision how to help us, if at all. We have to pay for this and they have even lied on official court doceuments (I have the evidence). All they have done is stress us out while we have had the worry of cancer. Plus the state does not help us either and only pay 30% of our mortgage which up untill 4 years ago all mortgage interest used to be paid. Now not only are cancer patient have the worry of dying they can lose their home as well. Is anybody else in this postion??

Its disgusting, and Im sorry I dont know the answer
On a side note mentally disabled people are in a similar position. If someone loses mental capacity and doesn't have an attorney, lenders have been known to ignore the rules, then go in and wipe out their entire estates.
Hope someone can help you asap

From what you have said, I think it is likely that you will have to go to court, however all is not lost. I suggest that you take all evidence of the circumstances of your health and more importantly an offer of payment to meet the monthly repayments and an AFFORDABLE additional sum to reduce the arrears - the arrears can be spread over the remaining term of the mortgage (cite Cheltenham & Gloucester B.S. v Norgan) asking that judge adjourn the hearing "generally" (or for say 6 months) on condition that you make the payments offered. You could also ask the court to make an order that costs not be charged to you due to SPML's conduct and lack of assistance.

Is your mortgage capital & interest (repayment mortgage)? Do you have a reasonable amount of equity in the property (size of loan against property value)? If so, you could get a full or partial suspension of monthly payments. The down side to this is it's a short term measure whereby the lender grants a payment holiday yet the arrears will build up over the period of suspension and it's granted on personal & financial circumstances.
Is there any chance of income from other sources? Have you exhausted the benefits open to you? Perhaps another option would be a rescue scheme where the property could be purchased and let to you?
Has every avenue available been explored by the lender as possession is a very last resort. Very sorry to hear of your problems; I take it you had no critical illness cover?

I'm not able to comment on the legalities of this, however I do know that, sadly, you're far from alone in this. I also know that this issue is of interest to atleast on of the big cancer charities - Macmillan, I'm sure if you contact them they will do alot to help

I've had first hand experience of a SPML repo, unfortunately you will have to go to court so a judge can put a stop to the bully-boy tactics that they seem to employ, in your case they seem to have made so many errors i don't think any judge will allow this to continue.

I hope that there is something that can be done to help you. I lost my house last year and having Cancer didn't make a difference to anybody.

The court did allow me two months to find alternate accomodation.

However a bright ending to the story, I had my stomach and lower oesophegus removed in Feb and am now well on the road to recovery. I have a new lease of life and hope you too get this chance. Debts and houses pale into insignificance when costed against your life.
