Default Rockwell Sent My Details To Someone Else

Just to explain I had a car loan with Blackhorse which was being collected by a company called Rockwell Debt Collection Agency. Last month i sent a cca asking for my credit agreement ect. I heard nothing until this morning when i received a letter from a very nice lady and this is what she had to say.


Dear Bxxxx
I hope you don't mind me writing to you but after i explain why i have you will understand
I have had a loan outstanding with Blackhorse for a while now and its being collected through a company called Rockwell Debt collection Agents.
Last month i asked them for a copy of my credit agreement and other financial details about the account - this was eventually received along with 8 pages relating to your account!!! Just to explain how serious i thought this is I know you had a car MXX XXX your date of birth xx/xx/xxxx. Your driving licence number AND your bank details at the time with the NatWest.
Firstly let me assure you that i am an honest 30 year old women and am thankful that these didn't land in someone's hand that isnt as honest as me. I have returned these papers back to Rockwell with a letter (very strongly worded) referring them to the Data Protection Act. To my knoweledge it id illegal to release private information to people without your consent which obviously you haven't given! I have told them i want an explanation as to why i was sent these papers and have warned them i will refer them to the financial ombudsman ( a company that regulates them to ensure they are working to strict guidelines) If i don't receive an answer from them.
If i can be of any help here is my number.

Please regard this as a formal complaint, under your Consumer Credit Act 2006 complaints procedure and under the Data Protection Act 1998.

On XXX, i recieved the enclosed letter, informing me that you has passed my sensitive personal data to a complete stranger. Could you inform me what steps you are taking to reduce any possible damage to myself, to improve your systems, and to compensate me for the potential inconvenience and distress your failure to comply with the Data protection procedures has caused me. Can you also guarantee that my personal data has not been distributed to any other third party.

please note that i have already complained to the information commissioners office on this matter, and if you do not satisfy me i will also complain to the Financial Ombudsman Service and to Trading Standards.

Yours truly,

XXX.

Send the nice woman a copy of the letter, thank her for her kind help, and point her on her way here, just in case, LOL

Personally I would also add something like:

"Not to mention the potential personal danger and possibility that my information could be used for future financial fraud using my details"

Or something along them lines.

I have written to Rockwell giving then 7 days to acknowlegde my complaint or i will be going to the Financial Ombudsman and Trading Standards.
I have also filled in a complaints form and sent it to the Information Commissioners Office.
And last but not least I have written to the the Lady who informed me of the breach of Data Protection Act and asked her to inform me of any contact she might have from Rockwell as she has also made a complaint to them.

Hi, also had a similar problem with car finance through Black Horse, except for it was Black Horse themselves who were the perpetrator. I received someone elses details (all very personal and completely against Data Protection), just to my address. I contacted FOS and they immediately intervened and to my knowledge fined Black Horse who were none to impressed, however made the same (costly) mistake the following month. Dreadful!
Complain, complain and complain! And yes, complain to Black Horse too (mind you they are as guilty!)
Good luck, and hope that they don't EVER repeat this, for you or any one else!

I received the folowing letter from ROCKWELL today.

Dear Mrs xxxxxxxxxxxxx
Re: Our Clients: Tessera Portfolio Management Limited
(Black Horse Limited)

We refer to your recent letter received at our office on 22nd June 2007 and have noted the contents.

Firstly, please accept our unreserved apologies for the error in remitting the statements held in respect of your Black Horse account (purchased by Tessera Portfolio Management Limited) to a Miss Rxxxxxx Rxxxxxxx in error.

We have already responded directly to Miss Rxxxxxxxx thanking her for advising us and requesting that she kindly destroys any information remaining in her possession relating to you.

This matter has also been brought to the attention of our Compliance Manager who is reviewing the post process in order to reiterate the importance of retaining confidentiality and complience within the data protection legislation. As a company we take pride in our professionalism and obviously such instances should never occur, however, on the rare occasion that they do they need to be addressed immediatley.

We can assure you that this is an exception rather than a rule as post enclosing confidential information such as this is " spot checked" to ensure compliance. However, human error cannot be eradicated and it appears that this has been the case in ths instance. Please therefore again accept our most sincere apolpgies for any inconvenience or distress this may have caused.

In this instance and given that Miss Rxxxxxxxx reported the matter immediately to us, we do believe that the information will not be used for any illegal purposes, however, should you suffer any loss due to this incident please return to us immediately.

We also confirm that to the best of our knowledge and belief no personal information has been distributed to any other third party, other than Fenton Cooper who now act on behalf of Tessera Portfolio Management Limited in this matter.

In view of the circumstances we trust that you will accept that this is due to human error and will accept our reserved apologies. However, please find enlosed a leaflet entited "Your complaint and the ombudsman Service" should you wish to avail yourself of the Financial Ombudsman Service. We trust that you will feel that this is not necessary in this instance.

Whilst writing, we confirm that a copy of yor letter together with this response has been passed to our Compliance manager.

Hi Again Bbcoops, and thank you for the update on your situation.
I would be interested to see who actually owns the debt (i know that you have CCA's Blakc horse and Fenton/Terressa), however the case has still arisen that your details managed to find their way to someone else with out blame to you but that Rockwells have apologised. Do you still want to take your complaint further (I would )?
I take it that you have not heard from the Information Commissioners Office?!
I think that while Rockwells have aknowledged wrong-doing, and have suggested to you that they have changed the way they work, in order that this does not happen again, if they are not formally reprimanded, how seriously are they being?
Hope this helps and makes sense.

Thank you for your responce. To be honest i am not happy with the responce from Rockwell although i really don't know what else i can do, I think if I take it any further they will accept Rockwells apology as the end of the matter, but if anyone has any suggestions i will be glad of the help.

Invite them to write the debt off and mark it down to a £-zero balance pending your choice not to report the matter to the OFT, the FOS, Trading Standards, and the Financial Crime Branch of HM Treasury...

Not forgetting of course... The Information Commissioner...!
