Please regard this as a formal complaint, under your Consumer Credit Act 2006 complaints procedure and under the Data Protection Act 1998.
On XXX, i recieved the enclosed letter, informing me that you has passed my sensitive personal data to a complete stranger. Could you inform me what steps you are taking to reduce any possible damage to myself, to improve your systems, and to compensate me for the potential inconvenience and distress your failure to comply with the Data protection procedures has caused me. Can you also guarantee that my personal data has not been distributed to any other third party.
please note that i have already complained to the information commissioners office on this matter, and if you do not satisfy me i will also complain to the Financial Ombudsman Service and to Trading Standards.

Dear Mrs xxxxxxxxxxxxx Re: Our Clients: Tessera Portfolio Management Limited (Black Horse Limited)
We refer to your recent letter received at our office on 22nd June 2007 and have noted the contents.
Firstly, please accept our unreserved apologies for the error in remitting the statements held in respect of your Black Horse account (purchased by Tessera Portfolio Management Limited) to a Miss Rxxxxxx Rxxxxxxx in error.
We have already responded directly to Miss Rxxxxxxxx thanking her for advising us and requesting that she kindly destroys any information remaining in her possession relating to you.
This matter has also been brought to the attention of our Compliance Manager who is reviewing the post process in order to reiterate the importance of retaining confidentiality and complience within the data protection legislation. As a company we take pride in our professionalism and obviously such instances should never occur, however, on the rare occasion that they do they need to be addressed immediatley.
We can assure you that this is an exception rather than a rule as post enclosing confidential information such as this is " spot checked" to ensure compliance. However, human error cannot be eradicated and it appears that this has been the case in ths instance. Please therefore again accept our most sincere apolpgies for any inconvenience or distress this may have caused.
In this instance and given that Miss Rxxxxxxxx reported the matter immediately to us, we do believe that the information will not be used for any illegal purposes, however, should you suffer any loss due to this incident please return to us immediately.
We also confirm that to the best of our knowledge and belief no personal information has been distributed to any other third party, other than Fenton Cooper who now act on behalf of Tessera Portfolio Management Limited in this matter.
In view of the circumstances we trust that you will accept that this is due to human error and will accept our reserved apologies. However, please find enlosed a leaflet entited "Your complaint and the ombudsman Service" should you wish to avail yourself of the Financial Ombudsman Service. We trust that you will feel that this is not necessary in this instance.
Whilst writing, we confirm that a copy of yor letter together with this response has been passed to our Compliance manager.

Invite them to write the debt off and mark it down to a £-zero balance pending your choice not to report the matter to the OFT, the FOS, Trading Standards, and the Financial Crime Branch of HM Treasury...
Not forgetting of course... The Information Commissioner...!
