Default Ombudsman ... for credit card claims?

Hi,

I am not sure whether to use the Ombudsman for credit card complaints, as they have said they consider £12 a fair charge after the OFT 'ruling'. I've told them it's not a ruling but only a report and not law, but they say they have to accept it. I've stated that it is the same principle as other penalty charges in that they are making a profit from it.

Problem is, i am not too confident about going to court, especially when i get an offer of all charges back but no interest. I have used the Ombudsman for current account claims and i found them brilliant, got me charges + stat and are even prepared to look at a higher interest rate as i insisted on restitution under fairness and balance etc.

So, anyone advice what i can do and also what interest rates are applicable for credit card claims as there is no 'unauthorised' rate to argue but the applicable rate from the statements.

They have twisted the OFT report. What the OFT actually stated was that they would not automatically investigate £12 as an unfair charge. They did not say you can charge £12.

As regards the interest rate you charge, this would be the same as your authorised borrowing rate. So basically whatever interest rate they charged you on the card.

Is this 100% and a court would accept this as standard?

I have been offered only the charges of £1000 back from one card company, and stat adds another £620 to the amount, with the standard interest rate from the statement adding another £1535. I asked for £2,550 in my prelim.

They now say they have a policy of 'no interest, never ever, no sirree'. I offered to settle for charges + stat which is what i will get at court, but they said 'nope, standard policy, no interest.'

Thats why i asked the question. Now i need to decide court (about 3 months?) or Ombudsman (about 5 weeks).

Ombudsman agrees with stat interest but says £12 a ruling.
