Default Do I ask RMA Or Barclaycard for CCA?

Hi everyone

Could someone point me to the right place to find out about asking for a CCA from Barclaycard Ive been looking through these forums and my head is spinning

I'm being pursued by a company called RMA for a £2,800 Barclaycard debt. I actually wrote to Barclaycard as soon as I knew I was going to start getting into trouble and they ignored my letters. Eventually they added charges to my defaulted payments.

The problem I have is, whilst I cant deny I spent the money, I really dont recall even applying for a Barclaycard! I have been on incapacity benefit for about 5 years and, with the help of a government scheme started up a PC Repair business. As part of that scheme I had to open a business account in joint names with the company the benefits agency used to manage the new business. A few months later after the business had started the Barclaycard came in the post. After about 6 months the original ill-health flared up again and I had to go back on benefits.

Do I ask for the cca though RMA? or Barclays? Are RMA just collecting on Barclaycards behalf or do they now own the debt? I'm really confused and not sure where to go next. RMA wont reply to my letters but insist on calling 2 or 3 times a day. Its probably not the right thing but Ive just been hanging up on them. Ive asked them to put everything in writing numerous times but they've never written back.

Can anyone point me in the rigth direction please? Thanks!

Welcome to the forum!

Send the CCA request to RMA. Be sure to include a p/o for £1 and make sure you use recorded delivery and keep the tracking receipt safe.

The clock starts ticking the day after confirmed delivery.

Also, try not to send to a PO Box address, if that's the case post again and someone should i'm sure be able to find the street address.

You should also send a Subject Access Request to Barclaycard and think about reclaiming the charges.

Don't ever speak to RMA on the 'phone. Tell them that they must only communicate in writing, refuse to go through security with them, just don't deal with them on the 'phone.

RMA never sign for their letters, they are a complete nightmare to deal with and NEVER listen to anything you have to say.

Try this for their address:
Old Docks House, Watery Lane, Preston, England, PR2 1AU

Its for NCO, but as they are the same company doesn't really matter.
I ended up sending my CCA there, and luckly they signe for it.
Oh well they are now in non-compliance and digging themselves deeper in the smelly stuff as I'm working with Trading Standards about their operation.

Also NEVER talk to them on the phone.
They will swear blind that the sky is RED just to get you to agree to anything.

Also it's worth talking to BT and either getting Choose to Refuse or even better changing your number, this is the only sure fire way I found to stop them calling.
I had 6 weeks where they called upwards of 5 times a day !!!!

They still haven't written to say they need my new number, but they have said they are sending my account to their "paramilitry Wing"
Now that will be fun, I can't wait.

Also LOG EVERYTHING in your deals with tme and report them to TS.
TS I have found are really helpful and completely non-judgemental, I'm sure Dave will say the same.

In that case, i'ld send by Special Delivery. More reliable, has to be signed for or refused. And if refused, correct me if i'm wrong, haven't they committed an Offence under the Postal Services Act 2000 ?

Just a quick update - I did exactly as stated on here and I havent heard from RMA since! Thankyou all so much for your help. I had another piece of good news today as well, Barclays have agreed to pay back my bank charges, £765.00!! Today has been great
