Default Stat Demand from Connaught/1st credit.

Had an Sd from these months ago which was in the form of a single page.
Have now been sent another, form 6.1, for a different debt.

What format have others received these in?

I would add that it was sent in an A4 envelope with 44p postage so I am not unduly worried at this stage. I am just curious as to others experiences especially given the 2 types of letter I have been sent.

Technically, an SD should be delivered by a bailiff or court officer, but you have to ask at court for them to tell you this!

Did you respond to the SD? They can file for your bankruptcy if you didn't.

From what I can see though, it seems to be a scare tatic of these people!

Havnt responded and do not intend to either.

To do so would confirm receipt and would place me in a worse position than now.

Obviously, no-one wants to come back here and post that they are the 1st but there are a few things that make me believe that its just like the rest, a bluff.

They don't know for sure my current address as they (connaught) are sending me letters to 2 addresses so how can they claim service at a last known address when they have sent letters prior to this SD at a different address (which is where I am staying for the time being) and just like most others on here, its been sent by normal post with no attempt at personal delivery.

You are right to ignore it. If you get a follow up letter offering you just one last chance to avoid bankruptcy write back and ask why you haven't received an SD and CCA them at the same time.

Need some help on this one. Have posted this problem before on here but got a bit confused.
Received a letter from Connaught Collections back in july that would issue bankrupcy if £2096 was not paid. stupidly phoned them and arranged to pay in instalments. They agreed, and was due to start paying 31/07/08. After much searching on internet found other postings about Connaught collections, and decided to request a copy of the CCA. so sent letter along with Postal order to them. Two days letter had a response from them and they kindly returned the postal order, saying that they would reduce the debt to £1090 ish pound almost 50% of the total debt but I would have to pay by the 15th August 08, and if not paid would refer back to Ist Credit. Firstly the debt is not with 1st credit but n old credit card I had with MBNA and it is over 6year old. What is my next course of action. Do i pay or not?

Do Not pay, they have to supply the credit agreement, by offering you a discount, they are in effect saying they cant find the agreement, no agreement no debt

So by refering back to first credit they really cannot do anything. Can you assure me i should not have any more nasty letters through the post. Can i ask just one questions, how come thay are able to reduce the debt to half? And did I make things worse by ringing them in the first place?

Yes

You have asked for the Credit agreement they have to supply it or pass you back to whoever set them on you, in this case 1st credit, 1st credit should have been made aware from connaught that you want the agreement, 1st credit should then contact the OC, so just wait until the next threat-o-gram turns up from connaught or 1st credit or some other low life

If you wish to accept their offer then do so however make sure that you get it in writing that this is a full and final settlement, otherwise 2 years on another pondlife will surface with the rest of the debt.

Personally I would hold out for the credit agreement, remember no agreement no enforceable debt

I was wondering if anyone can help, I recieved a stat demand by hand on 01/08/2008 from 1st credit/conaught, I rang conaught last night and asked for my c.c.a I told the lady that I had sent a letter to 1st credit asking for this and i had no reply, she told me that she would request this and the account to be put on hold, until i had recieved the c.c.a,l said that they have 12 days to supply me with this and she told me it could be upto 8 - 10 weeks, I asked if i need to still get the stat demand set a side ? she said there was no need to as the account would be on hold until further notice ?. she seemed realy nice, when i put the phone down i realised i should of asked for this info to be posted out, so i rang them back and spoke to the most unhelpfull arogant male, if he was there and then i would have punched the guy, i told him about the conversation with the lady and i would like it in writing he said i would not be able to set it a side on the grounds of the c.c.a, and any way he said that he had a recorded converationg going back to aug 2007 that says i offerd £50.00 per month and that is admiting the debt anyway, i refused to admit this to him, and he got very stropy, he said he would send out the coresponence from the previous call, im at a loose end can anyone help me please

If I were you I would get the SD set aside anyway, trust these people has far as you could throw them, nice lady telling you theres no need to set aside, yeah right.

use the failed cca request as the basis for the set aside, be quick you are running out of time.

and stop talking on the phone to them, everything in writing, that way they cant back track on what they have said

That is the correct idea, but if they issued the SD then you asked for the agreement , they have the upper hand, if you asked for the agreement then they issues the SD then you have the upper hand,

reading your post you requested the CCA by phone (never a good idea) after the SD was issued,
