Default Need Help!. Direct Legal COllections

I will keep this brief!.

I had a car on hp with VW finance. I gave the car to a local garage to sell for me, on the strength that when sold, the finance would be settled. Well....the car was sold and the owner of the garage refused to settle the finance, he gave me a few monthly payments which kept VW at bay for a while. Then he went bankrupt.

This left me with nearly £15k of hp to settle. Before any of you ask, there is no point going to the owner of the garage because he has no assets and there are a million and one creditors chasing him for money. I am certain he will never pay me this money back.

Anyway, Direct Legal Collections have now taken the debt from VW finance. I have not heard anything from DLC as yet. I really want to settle this without it going to court, my wife is pregnant with our first child and she really does not need the stress. I don't really know which way to turn, any help would be much appreciated.

I know i am completely liable for the car, and i have been completely stupid.

What should be my next step? (please don't mention the CAB because i have tried for months)

Do you have any paperwork of the agreement with the garage selling the car?

Did you give them the logbook etc?

Thanks for the reply.

I actually have a copy of the invoice from the garage to the customer. I believe the buyer bought the car through his company. The frightening thing is that he is driving the car around with finance still outstanding on the vehicle. The buyer has the log book etc...

I have nothing whatsoever, just the invoice, which i insisted from the owner of the garage. The garage no longer exists.

I need to have a think as the only only way round this may have legal implications as well as moral implications.
It may also be classed as perverting the course of justice, so i need to check everything is legal before i post my advice.

Hopefully someone else will have a idea for you in the mean time

When you do hear from DLC send them a CCA request.

This will hold things up until until you have a solution.

This is indeed a tricky one. The car is still owned by VW Finance. The garage owner had no right to sell it with existing finance on it. The person driving it now bought it in good faith but ultimately he does not own it. I can see the boys in blue becoming involved in this matter and the main culprit (the garage owner) will probably come out best from this mess
