I have an account with Kays catalogue which I run into difficulty paying over a year and a half ago they sent my debt to National Debt Recovery. They then bombarded me with letters and phone calls until I made an agreement with them to pay, I payed them regularly monthly up until I defaulted last month. The account is just over £1200 outstanding. I have only really realized that my agreement of £20 a month doesn’t even cover the interest charges which they are charging me each month so I’m going even more into arrears even with an affordable amount. They phoned me last week because I defaulted and told me I had to pay £80 a month to stop the interest charges, I got flustered on the phone and agreed to it but can’t afford it. Is there anybody who can give me any advice on this?

Should I send them a CCA or Subject Access Request

CCA first. See if they can legally enforce this debt.

Does anybody know which address I should the CCA to? Is it Nationwide Debt Recovery limited, P.O Box 55, Liverpool L2 2ST or their registered office which is 1st Floor, Skyways House, Speke Road, Speke, Liverpool, L70 1AB

I sent mine to their registered office. My o/h has had problems with her Kays account but is being dealt with by by NDR at Widnes. I don't know if you will find the same thing, but the Kays arrears office that dealt with it before passing it on had the same address as the NDR who is dealing with it now.

Have you checked that this National Debt Recoveries ltd company exists as I can't find them in companies house , may well need investigating further.

I've just come across this thread. My account was with Littlewoods, NDR in house debt collections. Will tell you how they play this as they don't have signed agreements. They issued me with a default notice which I ignored. They ignored me completely until they were nearly in default then rang me up out of the blue saying that they hadn't received a payment from that I was in default. I said thats funny I thought it was you that was in default as you hadn't provided me with a signed agreement. Went away. Their 12+2+30 days was up on Monday so they have now had the appropriate letter from me that until such time that an agreement turns up they can neither chase me for payments nor am I obliged to pay.

My daughter had Kays but her collections were through GGC Debt recovery and they played it differently. They passed to Moorcroft who we then CCA'd. They sent their usual letter (If this happens to your account) ignore this letter. Received further letter saying being passed back to original creditor. Kays then sent out a current agreement with just name and address on, nothing else. Wrote back and said that this was not a true signed copy of the agreement and was therefore not acceptable. Their time has now run out and they have now received the same letter has littlewoods.

hope this info helps. just sit back and wait and see which way they go.
