Hi I,m wondering if you can help please.
I am in the process of claiming back bank charges and now want to start of catalogue.

The first is a company called Studio who have charged me excessive amounts of amin and service charges amounting to hundreds if not thousands of pound.
I am about to request my first letter of charges.
When I get these can you please help by telling me how I go about sending the 2nd letter?
Is it done in the same way as a bank letter?
Can I request both admin and service charge fees back?

Also I am claiming against flexi about to send my 1st letter to them requesting charge amounts again huge amount of late payments etc.
Wat am I intitled to claim back from these and again so I send the first letter as this

My request
I am writing to ask you to refund to me the charges which you have levied from my account over the last 6 years.
I now understand that the regime of fees which you have been applying to my account in relation to direct debit refusals, exceeding overdraft limits and so forth are unlawful at Common Law, Statute and recent consumer regulations. If you say that they are not, then will you please demonstrate this by letting me have a full breakdown of the costs to which you have been put by as a result of my breaches, in order to reassure me that your penalties really do reflect your costs.
Additionally, it has now been confirmed that your particularly high level of penalties are considered to be unfair per se by the OFT who reported on the 5th April 2006 and are therefore presumed to be unlawful in the absence of specific proof to the contrary.

Your responsibilities
I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I am frankly shocked that you have operated my account in this way as I had always reposed confidence in your integrity and expertise as my fiduciary.
I consider that your repeated representations that your charges are fair and reasonable are deceptive and that they have deceived me into agreeing to pay them.
Your concealment of the true nature of your charges has prevented me from asserting my right until now.

What I require
I calculate that you have taken xxx which you have charged me in for the sum which you have taken.
I enclose a schedule of the charges which I am claiming with this letter


My targets to resolve this matter
I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets.

I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment.

If you do not respond, or you do not respond positively, within this time period, I shall send you a letter before action giving you a further 14 days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments.

After that, there will be no further communication from me and I shall issue a claim at the expiry of the second deadline.

If you're doing Studio....

CCA them 1st. They're known for not keeping copies of original agreements.

Scales??

Just one more question please.
I have a outstanding balance with studio of £1700. Am I right in claiming admin and service charges back? As the amount they offer probably wont match the balance how do I stop them from doing in the future or do I need a nil balance?

yep can confirm that Studio does not keep the signed agreement.
mine is only dinky at £79.59.
But moorcroft(dca acting on their behalf) is trying to enforce with threat of recovery in conty court... YET NO CCA=NO DEBT

Hi everyone.
I recived my a list today of charges of admin, adminstration etc after I rung yesterday to ask where my statements had got to. I runbg as I spoke to someone after making a payment who told me they were sent out friday and I still had'nt got them.
I rung and said I ahd payed the £10 cheque which had been cashed. The lady said oh I didnt realise you want the whol 4 years dating back, (yeah whatever love) anyway she told me it was sent out now (what happened to the promised ones friday I dont know) and that she had revised my account, thanks but no thanks once my blance is nil I,m saying goodbye to them.
Anyway I have added the amounts and the admincomes to £120 and the service is £475.46!!!

Monnie do you think I can claim both of these back?
I,m going to give it ago and see what happens they did include a letter saying they were within their rights to charge me £20 admin everytime i missed a payment, but will see.

Well best of luck all I'll keep you posted.

As far as i understand it...they may be within their rights to charge you £20 when you miss a payment but they have to prove it COSTS them £20 when you miss a payment which of course it does,nt

i don,t think i am wrong but you never know
