| Re: Lloyds Tsb - Will They Play Silly Buggers? Well guess what, Lloyds finally came up with a copy of my credit card agreement. In my view they broke the law in not getting it to me sooner. Unfortunately I can't read the date on the postmark, so it would be difficult to prove, so that's the end of that. Personally I can't see anything wrong with it, but if someone with a bit of expertise would care to have a look then I'd be grateful. I didn't expect much to come out of this in terms of it being non-enforceable. What always intrigued me was why I suddenly started paying protection against this card when previously I hadn't. I am as certain as I can be that I didn't sign for payment protection - I never have on any card so how that box came to be ticked is a bit of a mystery. The opportunity is clearly there for somebody to tick it afterwards - if I ever get my Subject Access Request details through then I'll have a better idea.

| Re: Lloyds Tsb - Will They Play Silly Buggers? Well, I've finally got the information from Lloyds regarding my credit card. To my surprise I find that I've been paying payment protection since day 1 though I don't ever remember signing for this.
Should this be a separate signature on the agreement box?

Fred | Hi Fred I now have application forms back from 2 cards only 1 agreement anyway I checked on the PPI on what I have one had a tick box for PPI and the other had a signiture required for PPI but they were both on application not agreement.

The reason is that I was in a DMP with the CCCS but they refused to stop payment to certain creditors. After a fair bit of dithering and a lot of discussion with my wife, we finally decided to stop the DMP and cease paying some creditors, LLoyds being chief amongst them.
So this is it, I've reached the point where things are now serious and I'll need as much help as I can get.

I believe this to be an application form. I'd really like something concrete to go on though, because I've had my first reminder letter from Lloyds today and I'm expecting the hassle to begin soon.

Fred | Hi Fred looks to be application to me, I have read that some applications also work as agreement but That is all I know as for the T&C as you have posted they are incomplete in that some of the clause's are missing ie see section 11 etc. So though they may have complied with s78 it don't look to me the have sent an enforceable agreement, but as always it needs some of the big bods to have a look. all the best dpick |
