Default WHAT! take my house

My wife received a phone call today ( at her place of work) from a dept collection company
This guy informed my wife that she has £1000 outstanding with Citi Cards & he was going to start proceedings to repossess our property.
So she has gone from receiving monthly statements from Citi, to being threatened by this guy on taking our property.
This cannot be right? She hasn’t received any letters from Citi or Dept collection company’s demanding money prior to this phone call
I’m no solicitor, I would have thought these sharks have a code of conduct to follow with regards to threats like this
Any views on this matter would be appreciated

there are MANY different pratices that seem unfair to me.

their behaviour is also blatant harrasment and a breach of section 40 of the administration of justice act 1970.

i would certainly be looking to take a complaint further, that truly is shocking. some info on harrament.

is it a credit card account? is there a county court judgment? have you kept up with payments? have they put anything to you in writing?

Yes, it’s a credit card.
She hasn’t even received any additional letters from Citi demanding she settles her balance & no, there isn’t any county court judgments against her.
As the mortgage is in joint names, this guy should also have some sort of dialog with me, shouldn’t he?

When the wife gets home from work, she will tell me more about this matter

He would not have dialogue with you per the data protection act but dont get concerned by this, they cannot possibly reposses your home it is a credit card not a loan and threfore not secured on property, if the amount is outstanding Citi should by law have informed your wife the debt was outstanding and was being reffered to a debt collection agency, they then have to contact via post to come to an arrangement and give you the chance to say what you can afford, they must also be able to produce a signed copy of your wifes Consumer Credit Agreement (CCA) or be able to get it from citi, that should be her first port of call, to write stating the debt is in dispute and she requires a copy of the CCA that will give stalling time as they cannot persue the debt until it is produced - there is a template letter for this on the forum.
Has she ever had charges incurred by citicard as she can reclaim them thus putting a large chunk out of the debt.
I had an alledged citi debt written of by a company citi sold an alleged debt to as they could not produce the CCA so well worth seeing if they have one.

My wife had £1,000 debt with Citi Card and guess what the charges amounted to, yes pretty much £1,000

It sounds like you know your rights anyway and are not really fazed by what they are threatening, but is it any wonder people are doing CCA requests to try to render their debts unenforceable when companies behave in this fashion
