I ve CCA Lewis debt recovery re a marble credit card and they defaulted on the original request, today they sent me this tryin to pass it as the Original Credit agreement.

This alleged credit agreement is just a priority application form with my details.
As far as i know it should say Consumer Credit Agreement detailing the APR and all that.
Is this an acceptable document?

It takes ages looking at adverts to see the file but I got there. It starts off by saying that it is a priority application form but where you've signed it it says that it's a credit agreement regulated by the Consumer Credit Act 1974, very scant in the way of terms and conditions and indeed your personal details, employment, banking history etc... I also noticed that the date is missing in the box where it says for office use and there is the word "date" there.

Try using "Photobucket" for files like this, it's much quicker! (I think i'm not supposed to include a link for a commercial site, so just Google it). Then when you have uploaded to P.B. you can post the image location and it will come out like this.....



And who's put that neat little cross in the PPI box? You or them??

It does say under "application", that it's an agreement.

Diskmandave i have thought about photobucket and done it.
The neat cross on the ppi is not mine its too neat as you state.
I am not convinced still this is what a consumer credit agreement should look like.
PS i am still waiting for hfc bank to reply to my Subject Access Request.

There are lots of interesting observations on this subject on my own thread with RBoS, more or less the same subject except there are less details on what they've provided you with. I've just started to collate all the advise in anticipation of RBoS wanting to know why i've stopped paying them!

Diskmandave i have decided to call in the professional.
I have made 2 different appointment with 2 different solicitors and i will report back the findings.
I have a gut feeling to challenge this application/agreement, but to make sure i do it correctly i am willing to get some legal advice.

personally i wouldnt accept that as a CCA - simply because its not dated by them, could he get off on this?
