Default Oh No! Help - Barclays & colemans-ctts.

Hi all,

Right, i owe Barclays Bank £1025, which was an overdraft i had with them which they closed due to inactivity a while ago now.

I had a final notice from Scotcall 08/03.
On the 10/03 i sent an Subject Access Request to Barclays and a CCA to Scotcall.

I had a letter friday from Colemans - CTTS Solicitors (Notice before legal proceedings) and unless i make full payment direct to RMA by 24/03 they are taking me to court.

Now the questions

Why are there three different company's after me?
How can i stall this? i am sure Barclays owe me quite a bit, so if they wait i will be able to give them a fair chunk and set up an arrangement thereafter.

I was told CCA don't work on bank overdrafts like they do on CCs and its not like the account is in dispute yet as i haven't had my statements sent through and so no request for monies owed to be paid.

So am i well and truly done on this one and just accept a CCJ?

Thanks for reading and any reply's are appreciated x

CCA all the people that are chasing you, that will help you determin who has the right to chase you for the debt, and will help you identify those who are chancing their arm!

due to the type of credit an overdraft is it SHOULD be covered by the CCA, depending on how much the overdraft is for.

The overdraft part of the bank account is covered under the CCA BUT there will not be a formal agreement for the overdraft. Its a flexible assumed agreement, which operates that way because of the timespan it covers. In theory an overdraft will be repaid as soon as funds are deposited so there is no formal period of repayment.

Peter is saying that the account and overdraft form a multiple agreement so a copy of the bank account agreement (which will include overdraft 'rules') should be supplied. This of course is still in the early stages of being experimental.

Making a CCA sec 77/78 request where a bank account or overdraft is involved will NOT produce a copy of the regulated credit agreement.
