Received this letter from Freemans.



IMPORTANT NOTICE ABOUT YOUR ACCOUNT

As you will be aware, as at 16-01-2007 there was an outstanding balance of ******** on your account. The account was being maanged on our behalf by EOS Solutions UK Plc.

We are writing to notify you that the balance of your outstanding account has been sold to Albis on 18-12-2006. They will now be responsible for collecting the money due on your account and they have decided to leave the account under the control of EOS Solutions UK plc.

All future enquiries and payments regarding the above account should still be addressed to:

I am looking into this on behalf of a friend of mine who doesn't have the confidence to deal with this herself!!! As the debt has been sold on, presumably at a tiny fraction of the balance, then she should be able to negotiate a full and final settlement figure. However, this account has been running along for about 6 years, with her paying about £25 a month off the balance and never missing a payment. Any ideas as to how to help??

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.
Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.
GE Money - Received settlement of £441, being total charges requested. No interest though.
CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!
EOS Solutions "ceased action on account" on behalf of a friend.

All in all, quite busy at the moment and enjoying every minute of it

Hi jaxads,

Freemans being a catalogue, (and coming under the remeit of CCA1974 even though they told me on many occasions they were exempt from it!) have you gone down the CCA request route to find out if they even have the correctly executed agreement to enable them to even pursue this debt? Not forgetting that if they dont, under what authority are they selling/passing your mates personal details from one company to another?

So I'll advise that she CCA's them. But would she CCA Freemans or EOS Solutions?? You would have thought that as Freemans have sold the debt, they sould have passed over the paperwork too????

My friend CCAd EOS a fortnight ago re. a catalogue debt and they wrote and told her that they could not supply a copy and had therefore closed the account !!

Most catalogues don't ask you to sign a CCA before issuing credit.... so when accounts are sold, they are usually sold without a CCA anyway.

these are also known as logic group plc. at the same address. i get letters and phone calls from both. they are nasty people on the phone. DON'T CALL THEM!

Update -- sent off CCA on 13 March, 1st class recorded. To be generous, allow 2 working days for postage - 15 March. Allow a further 12 working days for response - 2 April, plus 2 days postage (being quite generous here!). Should receive a response from them by 4 April. Still counting down the days ......................

12 working days from when they receive the CCA--have you tracked and traced the letter via Post Office website? Dont be generous to them, have they been generous before now ???

Just a small query. Most of these good folk open thei offices on a Saturday to be ever so helpful to their customers. Can we count Saturday as a working day for the purposes of the 12 Working days

There are other threads about the sale price of these debts. I havent seen any response from anyone negotiating a one off settlement for the amount they paid plus a small profit. If they only paid 5 or 10 pence in the pound there ought to be a deal there somewhere

You can't re-claim monied already paid to a DCA. Despite the amount that a DCA purchases a debt for, the full amount is still recoverable.... they would only need to produce the Deed of Assignment in court to prove it's existence.

I may have misread your post.... do you mean negotiate for a lower settlement figure if they can produce a CCA ?
