After A Coversation With A Person From Debitas A Few Days Ago Over A Debt To Capitol 1 Which I Am Paying Weekly The Rag On The Other End Of The Phone Told Me They Dont Own The Debt But Are Part Of Cap 1. Does That Mean They Have The Right To Threaten You With Court Action Or Is It As They Dont Own The Debt They Cant . After Reading Other Posts Should A Cca Be Sent To Them Bearing In Mind The Payments Go Straight To Cap 1 Direct

Are there any charges on the debt to reclaim?
You could CCA Debitas if you want, but why not CCA Cap1 directly? If they haven't sent you the OA within 12 working days of receiving it, they are in default and you can stop paying them until they do produce it.

Do not deal with these people on the phone. They can apparently be rude and threatening when phoning. If so, you are perfectly at liberty to be equally rude back to them-do not be intimidated by them. So advise them in writing that you will not speak to them by phone.
They cannot take you to Court but they can threaten on behalf of Cap 1 to
take you to Court if that is what Cap 1 wants. Although as you are paying weekly, I see no reason for taking you to Court.
Might be worthwhile sending them an Subject Access Request to see if there have been any
unlawful charges applied, and if so, reclaim them.

Debitas is one of mine and the missus.
As far as i see it Debitas is the in-house collectors from Cap1.
I sent them a CCA and the 12 working days are up tommorow. lets see what happens.
i received a threatogram they were issuing court claim while the CCA deadline is still on... looks dodgy to me...
