Some time ago I took out an unsecured loan with Northern Rock for £12,000 and all was going well until I changed jobs and the debt defaulted and went to £19,500 (added some sort of lump interest). Well during this time I had moved and was attempting to sell my house to clear some of the debts. But link bought the debt and got a charging order on the house. I nearly gave up and just said seize it and do what you want but I didn’t I battled on and eventually sold the house. I got link to lift the charging order on the house for a sum of £8000 and they said they would contact me for monthly payments for the rest. I gave them a letter through my solicitors which had my new address on etc I then heard nothing until 2 days ago when I got a letter from them via my solicitors saying I had not kept the agreement this is 1 year later. Not sure what would the best course of action be on this as im not sure where i stand due to the charging order please help.

i got a letter via my solicitors as follows

Dear Sirs

With reference to: Mr alix2

We write further to correspondence in April 2006. Your client paid £8000 for the charge on the property to be removed, but has failed to make any further payments. Would you please make immediate arrangements for your client to make further payments.

If we can be of any further assistance to you or you have any query in relation to this letter or on this account please contact a member or our legal team

I cant seem to find the official discharge letter but I do have a letter saying that they would accept the £8000 to lift the charging order and contact me for a payment arrangement for the rest. I did then supply them with a letter advising that this was ok and gave them my new address which is still my current address and to date have had no direct correspondence from them to this address. This letter via my solicitors is the first peep from them.

I would send them a Subject Access Request and start making arrangements to pay what you can afford.

When you get the Subject Access Request then the charges etc can be addressed, but it is important to pay something towards eh debt now as you obviously owe some of it, and there is a CCJ outstanding on it.

i have been reading tifo's thread and didnt want to hijack his so added to mine as i have a few questions :

If the ccj was made when I had moved address and was not present in court as i knew nothing of it is there any way around this. as I want to contest it and have the ccj removed.

ps i have the ccj showing on my equifax file but not on experian (strange)

Alix2.

The credit reference agencies reports can have different data upon them, as they provide services to different companies. They can only show the information that they have been given. Confusing as this may seem, there is no shared data source for creditor information.

I would have thought the CCJ would of been given before they applied for the charging order!
When did you hear about the charging order? Did you receive court papers for either the CCJ or charging order? Did you fill in and send back any court paperwork?

I don't see how you could possibly challenge the CCJ when you were aware it existed when you asked tehm to remove the charging order.

i only found out about the chrging order when i tried to complete the sale of the house that is how i became aware of it
