Default Wescot 'option' Order for sale and other problems HELPPPP!

I owe lloyds TSB £12,000 - i HAVE A charging order against my property for this amount and all this happened a few years ago when I didn't know where to turn.

I have not made an agreement to repay the debt as I thought that was the reason they held the order!

Today I receive a letter from Wescot, who now are dealing on behalf of LTSB...
tHEY OFFERED ME A REPAYMENT OF £7K and offered to write off £5k if i pay by april 06th. (yes £7k in a month, numptys!!)
They said if I do not pay, one of their options is an order for sale!

Last month I sent a Subject Access Request to ltsb as I believe alot of this £12k debt to be charges(£3-4k) I will persue them for this !!

Q. Where do I stand with wescot and what should my reply to them be, I like the offer of £7k but cannot repay that amount so soon, I was wondering if I could offer them say six grand over six years to get rid of the order,
Or if the tsb are liable for charges would that make the charging order defunkt??

Its alot to ask but there are lots of experts on here, please help if you can.

What is the 'debt' for, Credit Card? Bank Account ? Loan ?

It was a consolidation loan, they advised me to open a business account and I think it was classed as a business loan, need to check on the details, but i think it was originally for £8k after charges and court case it went to £12k, thanks for your assistance

Check the terms of your charging order, if you were not required to make payments on it I don't think they can just sell the property over your head.

It is rare for the court to allow a creditor who has a final charging order to sell your home. Most creditors are prepared to wait for you to sell your home at some point in the future and to be paid out of the proceeds of the sale. If a creditor is not prepared to wait, then they can apply to the court for a hearing for an order for sale. It is up to the court to decide whether to make an order for sale or not.
if you have kids or if there is anyone in the property who is ill/disabled then it would be pretty difficult for a creditor to get an order, although i will stress AGAIN that an order for sale is VERY rare!
