Question Letter from Moorcroft

Hi Guys,

a letter arrived from Moorcroft this morning after I sent a CCA request on Monday.

Thank you for your request for a signed copy of the relevant agreement under the Consumer Credit Act. We will contact our client and request the relevant information and ask that it be provided as quickly as possible.

In the meantime however we believe that it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation. Please could you give an indication of the information you will be providing, when giving evidence to the court or providing information to the relevant statutory authorities in relation to the alleged subject matter.

Please confirm whether for example when making a statement of truth in connection with any court proceedings you will be giving evidence as to whether or not you did not receive the goods/credit ordered.

Please could you provide this information by return, we beleive that this is a simple request that will assist in ensuring that all areas of dispute are identified as quickly as possible and potential costs are kept to a minimum level.



Please could someone tell me if this is a standard letter as it sounds very much like they are asking for a heads up on what I'm going to do so they can prepare themselves, or am I being too cynical?

Also as they have stated that they don't have a credit agreement and have asked their client (Littlewoods) for it do I still have to pay them any money, they have actually had a substantial sum from me in the past year, should I request for it back and pay it directly to Littlewoods?

Any info would be great,

Hi Lisa
I was just about to post with the very same problem,I got my letter this morning.Like yourself,I've been paying them for over a year for Empire Stores Catalogue. Hopefully, someone will be able to respond with the next step...cos I'm totally lost with this.

Hi Angel,

sounds like it may be a standard letter then, what a nerve!

I was going to wait it out and see if they can provide the credit agreement which I know they can't as I have never signed one.

I'm also waiting for my Subject Access Request from Littlewoods and I know that I have been charged penalties on that so will be claiming them back.

If they can't provide a CCA then the debt is unenfoceable so I will be going down this route with Moorcroft.

I am happy to pay for the goods I received from Littlewoods but this total does not add up to the amount they are chasing me for, so we shall wait and see.

Just a heads up angel, I have read on a couple of threads that after a CCA request you may get letters from Empire or whoever your with saying you are eligable for a £25000 competition entry or something along those lines and they ask you to sign and return the form confirming your details. On closer inspection this is actually a credit agreement, so beware!

Hope someone can clarify this for us, stay posted angel and let me know how you are getting on.

Thanks for that Lisa, so do we just ignore this from Moorcroft or do we respond in any way? As yet, I have not sent a S.A.R to Empire Stores.

They passed my debt to Moorcroft in the beginning because I was only sending half payments when I had to give up work (illness) Thought I was doing o-k by paying something according to my means.

Will follow your thread and advice given.

Just another thought after re-reading that letter, is it their way of skirting the issue of CCA? They haven't complied insofar as they have not returned the statement of account regarding all the payments made to them.

Reading lots of other threads indicates letting them default (12 days) then (31 days) so I'm guessing not to respond to this.

Anyone??

Hi Angel,

I agree I think it is just a way of stalling the CCA, I'm not going to respond until after the 31 days if they don't comply which I doubt they will.

Just a thought if you had to reduce your payments due to illness, were you paying any PPI to Empire, it's worth checking as you may be covered.

The one good thing about this letter is they have acknowledged the CCA request - I presume the letter is dated and signed - and they have begun digging themselves a hole into you should help them fall into.

They cannot change the timetable of a CCA request. 12 working days is what they have and that is laid down by law. When that runs out they cannot enforce this debt without a court order. If they fail to provide any details within a month following the end of this first period they have committed a criminal offence. Have you seen any burglars, shoplifters, muggers etc go to a judge and admit they've committed a crime but then ask to make the victim pay up? Exactly!

If this is a catalogue matter the likelihood is they don't have what a CCA demands and they are just stalling before the inevitable. At the end of the timetabled period report the scum to the OFT, trading standards and, if by then its the end of March, the FSO.

This year a major debt collecting company will be targetted by the authorities and an example made of them which will create ripples throughout the industry and force them to clean up their act. I live in Hope (near Wrexham!)

yes, its a standard letter. I got one as well (actually two as i have two debts with them).

i just ignored it and let them default on the time.

they have no right asking what you intend to do anyway, its just a way to scare you by mentioning 'court action'.

Thank you both for your replies. I did think it strange they want us to provide them with our intentions.
I don't have a problem with repaying my debt to Empire but these people (Moorcroft) scared me into paying them 18 months ago and I always thought the money was going back to Empire.Stupid me!!!

i got the same letter!!!!!! then i got another letter a few days later saying that theydont have the cca on this ocassion and passed the debt back to the original company!!!!!

I had dealings with Moorcroft last year with regard to Great Universal, I upset them greatly by paying the debt direct to GUS. I didn't dispute it or anything, I had just gotten a bit behind, didn't know about CCA, but just made the payments via internet banking straight to GUS and Moorcroft were not happy about it.

Then in November I got another letter from the about Orange, I agreed with the agent to pay Orange direct, again I didn't dispute it, agreed monthly payments.

Low and behold after the first payment was made I got a snotty letter from Moorcroft saying that I hadn't paid it, so ignored it, gave it a day or so and then paid Orange off in full direct to Orange, got another snotty letter warnign of intended litigation. At that point I phoned them, they told me that the debt had been passed back to Orange and that they (Moorcroft would send me a letter confirming this and that the debt was paid in full) still waiting for that letter!

The happy feelings came from knowing that I had paid the debts off, paid them to the original creditor and there was naff all that Moorcroft could do! (and they was piffed about it!)
