I sent off CCA request to lowell who hounded me from beginning Dec 06 for £417.

They still have not replied but rang today saying they have the agreement.

Can they still pursue for the outstanding amount?????:o

When did you send the CCA? Did you sent the £1 statutory fee too?a phone call from them saying they have the agreement means nothing, they have to comply with your CCA request with true copies. IF they have not responded with these copies after 12 days ( allow extra 2 for postal service) then the debt becomes unenforceable until they produce them, should they not produce them one month (£! DAYS) after the initial 12 days they commit an offence and will have to explain to a judge why they committed the offence before the Judge will even entertain considering reinstating!

Hi Falcon,

CCA sent on 29th December 06 with the £1.00 statutory fee.

They have sent letter confirming receipt of this dated 5th January 2007.

Nothing sent so far just the phone call from a stroppy individual who said they actually had 90 days and that i needed to get my facts right as he knew the law

Is he right or wrong???

tell him he's got it wrong.

Its 12 working days and then 1 calendar month. Tell him to read the CCA 1974.

Also, i have proof from OFT its that time and can let you have it if needed.

I'm in the same boat as you, but Lowell Financial have gone mute since I sent them the CCA request! A few more days now b4 they commit the offence.

BTW... NEVER speak to these people on the phone! In writing only!

Hi all,
I have received a copy of form 4544 application certificate from Lowell which states that it is the capital 1 credit card agreement signed on the 05/02/01.

This was sent to me and received on the 12th Feb 07 when i requested this on the 29th December 06.

I have received a letter today from Hamptons ( Smirk, Grin) stating that i must contact them as a matter of urgency to rectify the outstanding amount of £377.99.

I sent prelim to Cap 1 for £360 in charges on 2nd Feb 07.

What should I do next with the Hamptons at Hamptons???????

A bit worried about this at minute despite the jokes. Help Please!!!

14-1-07 sent LBA to Halifax
2-02-07 Filed Court Claim today
7-2-07 Deemed served on Halifax, they have until 21st Feb to respond.

Sent S.A.R to Capitol 1 on 29-12-06
28-01-07 Got Statements back
2-2-07 Sent Prelim

29-12-06 CCA sent to Lowell
5-1-07 Lowell Acknowledge fee & Letter
9-1-07 Lowell say not received fee & letter
16-1-07 Lowell say they got fee and letter
5-2-07 Lowell cant supply Agreement form and have frozen account

Chaddy,

Take a good look at the small print on the bottom of the Hamptons letter.

It's just a trading name of Lowells,..... so it's just another scare tactic. Don't worry about Hamptons legal, they have no authority whatsoever.

I'm not too sure what 4544 means, so this is one for the experts.

You're quite right to have a grin about it all....Lowells/Hamptons are a pretty incompetent bunch and it sounds like it could all be over soon. (In your favour)

got letter from Hamptons at Hamptons stating they will go to County Court in 3 days if no payment received. Anybody else had this???

It's too late - if Lowell have failed to provide you with a true copy of the CCA within the permitted timescale, then there's nothing they can do. It's a last ditch attempt to get you to pay.

Unless anyone has other advice, I would say completely ignore it.

Hang on a sec......4544, is that a copy of the original agreement ??

We need to be sure they haven't sent you a copy of an agreement they have, within the legal timescale.

Glancing back through earlier posts, it looks like the answer to that is no, so I think you're in the clear.

Best get a second opinion though, if anyone would care to take a look.
