Default Advice on Moorcroft please?

Hi,

I've received a letter from Moorcroft demanding I pay up for an overdraft I had with HSBC.

I've tried to contact HSBC about this however they refuse to talk to me or give me anymore info apart and say I have to deal with Moorcroft now.

Can someone explain to me how I should proceed with this? I spoke to Moorcroft and they said they are 'sending this to their court division and I could expect to be sued soon'.

Do I have to deal with these people? They haven't purchased the debt and are collecting on behalf of HSBC.

They insisted that they would take me to court if I didn't start making payments, and I told them I will deal with HSBC and not themselves.

Can anyone let me know where I stand?

Hi

Don't know wether this will help are you disputing the debt if not ring them and say you can only afford x amount per month send a statement of intent if you want but usually they will accept a part monthly payment i deal with thm and they seem ok

Not sure, what is actual problem, did you have o/d with hsbc and have since closed account they have then sent debt to moorcroft ???

If you are claiming bank charges this shouldn't be a problem you can still claim bank charges even if account has been closed.

Moorcroft dont want to take you to court but be careful they dont send debt on thats when it can become nasty

Hi Maria,

Yes thats correct, I had an overdraft with HSBC who have now closed the account and am now getting hassled by moorcroft.

What do you mean by:

What should I be doing? Should I just be paying moorcroft this debt as I keep reading other posts about not paying them anything/speaking to them unless they can provide a CCA etc?

I'm a bit confused about what powers Moorcroft actually have.

i am in exactly the same position except with the nat west they closed my account and have instructed moorcroft to recover the debt i dont dispute the debt and have agreed a repayment but i am also lost as to what moor croft can acctually do

Hi,

Don't make any admissions to anybody. Inform Moorcroft that the account is in dispute, and you will be dealing with HSBC directly. Phone HSBC in the morning and tell them you now dispute the account, and that they should update their records accordingly.

Then mak a Subject Access Request to HSBC (template on this site) and include a £10.00 cheque or postal order (make a note of the PO No. in your letter so it doesn't go missing).

Once you have your information from them, which you are entitled to under the Data Protection Act 1998, use a highlighter to mark out all of the charges made to the account.

Then, input these dates and amounts into one of the spreadsheets (in the Library) and make a claim to HSBC.

If in doubt, look through the FAQ's before going any further.
