Was this debt passed onto a DCA and that's why you hadn't heard of them?
Once you establish who the debt originally belonged to then action can be taken.

| Re: MacKenzie hall ....again !!! Do you still have any of the letters? If so, I would send it to them with a CCA request. I did find this address for mackenzie Hall: 30 The Foregate, Ayrshire, Kilmarnock, KA1 1LU. If you can't find a refernce number, look at the Subject Access Request letter which, if I recall correctly, states that they ahve been happy to use the info you privide (i.e. address, name, DOB) previously and so should be happy to do so know.

If you get letters demanding money from people you've never heard of don't pay it but Busboy, by logging onto this site you have done the right thing because there is every possibility you may get your money back. But it's going to take a little while.
You should now write to Mackenzie Hall at the address given by tiglet and tell them the debt is disputed and you want documentary proof it ever existed. This means sending the CCA letter to them - you'll find it as letter N in the stickys at the top of the forum. Sent by recorded delivery and accompanied by a £1 postal order the leeches have 12 working days to send you a signed copy of the application form you may or may not have signed, a deed of assignment (their right to collect) and a statement of account.
If MHall fail to comply (or even respond) within the 12 days send them a SARN notice. This will cost £10 and gives them 40 days (calendar) to come up with all the documents they hold on you.
Failure to comply with both means your case against them strengthens. At that stage report them to the Office of Fair Trading and the Information Commissioner but also send them a letter before action. This will give them seven or 14 days to repay the money you paid them (plus interest and costs). If they don't a county court claim will be lodged. The papers to lodge will be their letters to you, your letters to them and the reports to the statutory authorities.
It will take just one case to prove to firms like MHall that they cannot mess about with clients who know their rights.

Both are aware of a lot of complaints and if we want to get these disgusting tactics to stop, we need to actually amke the complaints to the relevant people. |

Can anyone help me as I really dont know what to do about this, I being b chased by Mackenzie Hall on behalf of HSBC Bank, of this debt that I owe them I am not sure of how much of it is actual bank charges, and they continue to chase me even tho the debt is now over six years old, would I still be able to request bank statements to find out how much of the original debt and dispute the bank charges, or under the 6 year rule that the debt would be written off anyway because its been over 6 years since I had anything to do with the HSBC, and have never spoken to mackenzie hall, any advice anyone can give me would be really helpful

I posted this on general consumer issues because I didnt find the link in time for this one, just to also add that mackenzie hall have also been in touch with a company called "MeritForce" for an authorised collectors visit and if I dont get in touch with them by 8th November 2007 making a "Positive Commitment" to clearing the debt, my account will be returned to the Meritforce office for "Potential legal action" I know I have have left it late, but have worried myself sick over this, and I would appreciate any advice on how I can confront them. |
