| rogerk - Robinson Way/Catalogue debts Hi Folks, First off, hello all I'm new and hope I'm posting in the right place.
My daughter had a catalogue account and got into financial difficulty as a result, the account has been passed to Robinson Way (DCA) for collection. My daughter has written to them and phoned them on several occassions asking for a bank account number and sort code whereby she can make payments via internet banking. No joy, they just keep sending a giro slip instead of the details requested.
Latest move RW have issued a County Court summons for the debt plus costs etc. My daughter wishes to defend the costs part of the action, as there really was no need for this action, all they needed to do was respond with the account number etc.
I have read somewhere, that under the Credit Consumer Act section 60/61, catalogue debts cannot be recovered through a court, or any other means if there is no executed agreement. Can anyone offer any information. Any guidance would be appreciated before we fill out the response to the summons.
Thanks in advance |

| Re: Robinson Way - Urgent Advice Needed send a cca of to robinson way. Also the bank details are on the giro slip if you carefully the sort code will be somewhere in the middle and on the side will be either a account number or it will say ho collection account or even bulk account etc. if it says this then the account number is 00000000 plus the sort code. when you pay via the internet your refrence number is what the computer system links with your dc account with robinson way. However if they have issued and you say that they have refused to give you their bank account details then you would be wrong as this is printed on thier paying in slip also the same should be on the reverse of thier bill. If it is only a small amount pay it and notify the court. If however you think that there are illegal collection charges or even unfair penalty charges then you need to send robinson way a Subject Access Request and mention this in the defence. Do not that when you defend a date will be listed at court. If by this time robinson way do not reply to the S.A.R - (Subject Access Request) then you have a case against them. |

| Re: Robinson Way - Urgent Advice Needed Thanks i_spam, the problem is, it appears that the bank account number shown on their giro slip will not accept internet transactions and is therefore rejected by the internet banking system and nowhere on their paperwork does it provide any other account number, nor will they provide another account number.
Now to the ignorant questions, what do you mean by send a cca to Robinson Way and what exactly is a S A R. Sorry to be a pain, but I am new to this terminology.
Thanks for your reply. |
