Default Godebt/advice needed.

Hi All,

Has anyone had any dealings with a company called Godebt who are a debt collection agency based in Cardiff.
They also sometimes use the names "Edwards Geldards" and "Hollis Briggs".

Rather than negotiate with debtors, they usually intimidate with threats of bankruptcy. Up until recently Godebt bought a lot of debts from Yes Car Credit and the Edwards Geldards arm tends to buy mortgage shortfall debts.

I would be grateful for any comments regarding these companies, whether positive or negative, either on this thread, or alternatively at www.saynotoyes.co.uk

I was going to post it here originally, but put it in the "other institutions " section for people who have had dealings with them not necessarily in relation to Yes Car Credit and for other members who may be unaware of the relationship of the three companies with each other.

I am being chased by godebt at the moment I would be interested to know how they operate I am currently asking for my consumer credit agreement. I have been threatened after one week with a statutory demand in Bankrupycy. I am not really sure if this is just a empty threat as the letter looks like a generic letter. My debt is almost at 6 years
, so I am trying to get to that point.
Does anyone else have any info on them.

Hi

we are currently experiencing threatening, rude, abusive and non legal behaviour from Go Debt. We have also requested a copy of the agreement my husband signed two years ago to see if it is in breach of the CCA and also to see if a mis sale of PPI also took place. Upon requesting this information i was advised that due to my attitude and the fact that i had complained about Go Debts employees attitude to debtors then they will be proceeding with bankruptcy against my husband.

The firm clearly do not follow the OFT's guidance for debt recovery nor do they adhere to the Credit Association Services code of practice, as they due use bullying and agressive tatics in oredr to try and recover money.

Due to the nature of their business the firm should have a consumer credit licience and luckily with effect from 6th April 2007 compliants regarding such firms will be able to complain to the financial ombudsman service!

We are finding that the firm do not ask if it is convenient to talk and do not worry about embarrassing you which again is not allowable under the CCA!

Although we are aware that this firm are breaching areas of legislation we are seeking legal support so will let you know how we get on!

Please report GO DEBT immediately to the OFT in London.

They have the power to rescind their consumer credit licence which would in effect close them down as it would be illegal for them to act at all as debt collectors without the licence.

The OFT and the DTI will need hard evidence of their actions and their blatant flouting of the law.

We have experience of the OFT closing down debt collectors before and with the correct information and proof they can cease them trading.

NB At present Go Debt are late in filing their own returns to Companies House this is illegal and is in fact a criminal offence.

We are today commencing an immediate investigation into Go Debt and its practices and we will ourselves seek the termination of its licence should it persist to harrass and intimidate outside of the confines of the rules set out in the granting of a CCA licence.

We have experience of working with the DTI and OFT and BBC watchdog in the past and will not hesitate to proceed aginst this company should it continue to step outside the law in the pursuit of its aims.

Any further test cases will be useful.

Go debt have now issued me with a photograph of where I live and are threatening bankrupcy. Interesting as I do not own my house.
How do I go about becoming a test case?

Contact the OFT in London and confirm you wish to file an official complaint against GO DEBT and its breaches of the CCA and want to call its licence into Question.

Ring and then Write to GO DEBT stating you will not be bullied in this way by them and tell them you are contacting the OFT and the DTI for an immediate investigation into your case and will also pass your papers to the FSA ombudsman which you are allowed to do after the 6th April.

Tell them should they persist down this bullying route and not assist you in providing the information then you have no alternative but to call for their Consumer credit licence to be rescinded by the OFT .

This would in affect put them out of business.

I would also immdeiately take your case to you local Citizens advice bureau for impartial advice.Take all your papers and phone notes and names of the contacts at GO DEBT you have had contact with.

You need to stop them in your tracks.

Hi there, I have just done a search and your Forum came up with some interesting postings about Go Debt. I too am having rude, and bullying phone calls at work not just on my mobile. I was reduced to tears in front of my boss even when I told the person on the end of the phone I couldn't talk and it wasn't a good time. Is there anywhere that I can go to complain? Any response would be greatfully appreciated.

Have a look at FAQs - consumer credit complaints for details of the new complaints system. Note that you must first follow the DCA's own complaints procedure first.

As always when dealing with DCAs, don't speak to them on the telephone. Write to them stating that you will only deal with the matter in writing. There's a telephone harassment letter in Templates that you can send if they don't stop.

Write to William Rhodes or Fay Sims (joint Managing Directors) and ask them to send you a copy of their complaints procedure. If they do, follow it, and then go to the FOS. If they don't go straight to FOS and tell them Godebt have ignored your letters.

Thank you so much for this. I have done some research on this company and really feel that the BBC should do a follow up on YCC and the aftermath of what's been left behind and how 'customers' are being treated.

I did write in February to Godebt stating that I didn't want any further phone calls and to write to me only and complained about one member of staff but this fell on deaf ears and I've still been getting the phone calls.

We are currently experiencing problems from GoDebt re missold ppi from YCC their finance house being then Auto Car Direct which I believe is/was an offshoot of Provident. Can anyone tell me how to defer threatened bankruptcy proceedings for something which we now know we are not liable for and which in fact we could counterclaim for---not to mention the bullying, harrassment etc from GoDebts solicitors Hollis Briggs, standing in neighbours garden opposite house taking photographs and abusive phone calls. I note one common thread from GD and that is that it seems impossible to get anything in writing from them! Does this mean that their threats are just that and not enforceable by law, anyone please?

Due to a move (no fault of my own - I was ill) from on end of the country to another and not being able to find another job I was not able to keep up with the payments.

Yes car credit told me that if I handed back the car that I would not have any further money to pay that that would be it.

So I handed back the car.

A week later I was chased by GoDebt for the outstanding balance which was about £5000.

They most annoying thing was at the time I had only had the car for 8 months and I bought if from them for about £3500 but when they resold it they only got £1500!! My car devalued by £2000 in 8 months.

I queried with GoDebt the integrity of Yes Car Cedit at the time and stated that I had been completely done over and they said that as long as I paid them back an amount which is only £25 a month they were happy with that - for a debt company to be happy to receive this measly amount they must know that Yes Car Credit are in the wrong and they are getting money out of me that they shouldn't be getting.

However at the moment I am not sure how to go about challenging it so to keep GoDebt happy I am happy to part with £25 a month.

If anybody knows how to take these slime balls down I am happy to give it a go - as I still have about £4,500 left I would be happy for any pointers.

Also Go Debt rang me last week and offered if I was to settle that they would reduce the debt by half?? Unfotrunatly as I dont have a dime to rub together I am not able to take advantage - but such a huge reduction they must be getting itchy feet and trying to revcover whatever they can.

If you are able and I know it is not ideal but when they next call at work get a friend to say that you no longer work there then at least they will stop bothering you at work.

Hi I have a similar situation as you. I have'nt seeked any advice my story is a couple of years ago I made a huge mistake by going to get a car from YCC I was self employed young and stupid so I got a car from them. I could'nt afford to pay them so I asked if I could call off my contract (within 7 days) but they kept ignoring and telling me they would call me back. They reposesed the car now im lumbered with a £6000 debt with GoDebt. They called and hassled me and threatened bankruptcy and even said my mum could get chucked out her house! They were telling me to borrow the money off a friend or family to avoid bankruptcy. Is there anything atal I can do im currently paying £30 a month but I don't think it's fair I have to pay £6000 for something I have'nt got. Or is that just the way it is when you sighn the contract? My parents always advised me not to take the car but being at a young age you think it's all ok and not think about the consequences.

Any help would be much appreciated.

My girlfriend had a letter from godebt about 7 weeks ago for a debt from 4 years ago. After being quite persistent for a couple of weeks, we sent a holding letter telling them we were getting legal advice and would contact them shortly (which we are).

Its been 5 weeks and we have been really surpised not to have heard from them since. It seems really odd, given the aggressive reputation that they have. We obviously dont think for one minute that we have got rid of them, but do you think we might have been put to the bottom of their priority list, so to speak, since we mentioned a legal team?

Or is it standard for them to wait 6 weeks or so?

My son purchased a car from them and when he had paid over half of the purchase price handed the car back.
They keep saying he still owes thousands of pounds to them for insurances that he never asked for. Apparently this is a common problem with car company's like YES!
they ring up threatening and always ask if my address is my sons girlfriend's who they also ring on a regular basis and they ask her if she is at my address bunch of nutters:o

Just thought people dealing with Go Debt would like to know that I have just found out that they have sent my bank details, signatures and pervious address information to another one of their customers.

I am in the process of dealing with this matter through the information commissioner's office but it makes you wonder how many other people have my information because of these people and how many other peoples information they have sent out. I was lucky this time the person in question was good enough to track me down and let me know they had this information.

If anyone knows what else other than contacting the Information Commissioner`s Office I can do please let me know because I do not want them to get off lightly with this obvious breach of data protection act.

i am currently having problems with go debt. they are refusing to let me pay my £11 000 debt by instalments and say that unless i can settle it they are going to send the bailiffs in. how do i get to the templates so i can send them a letter asking for the origianal credit agreement out to me so i can check if it's legal?
